NY State's definition of rape does not include anal or oral penetration.

The 24-year-old woman who was raped at gunpoint by an NYPD officer is in no hurry to relive the ordeal of another trial.

This means that Michael Pena "must serve at least 75 years before even seeing a parole board."

Before the partial verdict was handed down, the trial was mired in confusion when it was revealed that one of the jurors was a friend of Manhattan District Attorney Cyrus Vance.

Police are investigating whether Michael Pena was involved in two other sexual assaults in the last three years. And they revealed that Pena was once hit with a brutality suit for assaulting a perp.

“There is absolutely no doubt that there was no intent on the part of Michael Pena to hurt anyone. There was certainly no intent to sexually abuse anybody on that day," said defense attorney Martin Goldberg.

"Everything's not black and white," the 27-year-old police officer told a reporter at Rikers. "There are shades of gray."
