The city's Department of Health and Mental Hygiene has deemed either seven or three bars in the city smoking bars. The Post says there are seven, but says some of the special status they were able to have smoking under may be revoked. The Daily News says there are three bars, Karma Lounge in the East Village, cigar bar Club Macanudo on East 63rd, and VFW Post 107 at 2414 Gerritsen Ave., Brooklyn.

The News also reports that the Empire State Restaurant and Tavern Association are moving ahead with a suit, with their president saying, "We have identified several flaws in the new state smoking ban law that we believe will lead to the court overturning the law." NYC CLASH, "Citizens Lobbying Against Smoker Harrassment," is filing a suit also.
