A former police officer who sold an analogue of GHB, otherwise known as "the date rape drug," out of his home was sentenced to eight years in prison yesterday, according to a press release from the U.S. Attorney's office.

Robert Smutek, a former police officer and drug task force member in Dutchess County, sold the chemical under the name Potion 9 through a website he operated out of his home in Sleepy Hollow. The website, Online Coral Calcium, sold patent medicines.

Potion 9 was marketed as "mood enhancer" that contained natural ingredients. But evidence at Smutek's trial revealed that Potion 9 actually contained 1,4 butanediol, which turns into GHB in the body when ingested. Smutek sold 200,000 of the bottles between 2009 and 2014, netting him 1.2 million dollars.

Smutek was found guilty by a jury in April. In addition to his jail time, Smutek was sentenced to three years of supervised release, and had to relinquish the money he made selling Potion 9.

“Smutek, a former police officer, was peddling a date rape drug over the Internet from his suburban home. The sentence imposed on him by the Court properly reflects the callous nature of his years-long drug dealing,” U.S. Attorney Preet Bharara said in a statement following the sentencing.
