According to Joey Jackson, the lawyer representing the Department of Corrections officer shot in the arm by plainclothes cops after he allegedly pointed a loaded gun at them, officer Victor Hernandez didn't realize where he was aiming. Why? "It was dark. They weren't uniformed." The cops claim they had their badges around their necks and identified themselves as police before Hernandez raised his gun, but Jackson told the Daily News, "I don't want to blame the police—but when the police are undercover, it's difficult to determine if they're the police or people in the community who meant him harm."
