The 42-year-old homeless "drifter" accused of raping a 73-year-old woman in Central Park on Wednesday was charged with predatory sexual assault, rape, criminal sex act and robbery assault. When David Mitchell was being walked out of the Special Victims Squad, he "spat at a Post reporter’s face when asked about his alleged crimes."

You can watch the video below—according to WCBS 2, someone asked, "What do you have to say for yourself?" and the video features the lead-up to the question: "David, you raped and beat a 73-year-old woman!"

Apparently Mitchell said, "I attacked no one!" The NY Times notes that Mitchell "hailed from the South and spent most of his adult life in and out of prison on a grab bag of felonies, including kidnapping and abduction... The suspect, David Albert Mitchell, 42, was nothing if not distinctive. His body was a canvas of dark, mythical tattoos: a grim reaper, dragons, Nordic warriors, castles and “some kind of deadly insect,” said Paul J. Browne, the Police Department’s chief spokesman. Other tattoos included two teardrops under Mr. Mitchell’s left eye and one small teardrop below his right."

The 73-year-old victim had been birdwatching in Central Park, right by the tourist attraction of Strawberry Fields (which is very close to the West 72nd Street and Central Park entrance to the park), during the day when she was attacked and raped before noon. She was found by another birdwatcher, who said she was lucid, though very badly beaten in the face.

The victim said that she believed her rapist was the same man she saw masturbating in Ramble two weeks ago. During that incident, she had taken his photograph, only to anger him. He demanded she give him the film (but the camera was digital). The victim said that on Wednesday, the suspect came up to her and said, "Do you remember me?" and attacked her.

Three police officers spotted him walking on Amsterdam and West 77th Street a few hours after. Another man said he had been threatened by Mitchell on August 20. Ayrton Ferreria dos Santos told the Daily News, "He pulled a 6-inch shank on me. It all happened over a joint"—because dos Santos didn't want to smoke with him.

As for Mitchell's history, the Post recounts:

He was previously charged with sex assault and first-degree murder in West Virginia for the fatal beating of an 86-year-old woman named Annie Parks.

Mitchell, then 18, allegedly killed her with a blunt object, then agreed to plead guilty to murder. But prosecutors insisted on a trial, and he was acquitted.

A few months later, he was busted for a home-invasion rape of a woman in her 70s and stealing her gun. He pleaded guilty to first-degree robbery and served eight years.
In 2003, he was convicted in Virginia of abduction and kidnapping and served another eight years.

The victim in that case, his sister-in-law and former girlfriend Saretta Mitchell, told The Associated Press yesterday he was “a sick individual as far as sex goes,” and that his problems are “always sexually driven.”

Yesterday, the victim said, "Kill him. Cut off his penis. That’s fine. Cut off his feet, then hit him over the head. Then give him life in prison... I hope he goes to jail for a long time, and he gets raped, over and over again."
