The Post reports that waiters are suing the owner of West Village eatery Da Silvano, arguing that they were illegally required to share tips with their managers and were not compensated fully for the hours they worked.

Silvano Marchetto, who owns the four decade-old Italian restaurant, has been named in the class-action suit, which was filed yesterday. Marchetto denies that his waitstaff was treated unfairly. "They got paid correctly, like everybody else," he told the tabloid.

Da Silvano celebrated its 40th birthday last month. In 2011, Marchetto was hit with a sexual assault lawsuit after a garage manager accused him of fondling his genitals; that lawsuit has since been settled for an undisclosed sum.
