The only people who love horrible puns more than the media are the pornographers (ha, yes, these days it CAN be hard to tell the difference). Porn producers know the only way to persuade men to buy their sex videos is with catchy titles like Shaving Ryan's Privates and Tits a Wonderful Life. But one California porn purveyor may have gone too far with its series of "Ben & Cherry's" porn videos. Caballero Video is being sued by Vermont-based ice cream company Ben & Jerry's for "outrageous copying and misappropriation" of intellectual property.

According to the lawsuit, the X-rated names such as "Boston Cream Thigh," ''New York Fat & Chunky" and "Peanut Butter D-Cup" are obvious references to Ben & Jerry's flavors "Boston Cream Pie," ''New York Super Fudge Chunk" and "Peanut Butter Cup." There's also an "Americone Cream”—inspired by Ben & Jerry's Stephen Colbert flavor Americone Dream—promising “a delicious mix of hot American gay men." The packaging on the videos, as you can see here, also evokes the design of Ben & Jerry's ice cream containers.

Lawyers for the ice cream company also argue that Ben & Jerry's "famous and distinctive” slogan has been perverted into "Porno’s Finest" and "is likely to cause confusion in the minds of consumers." Indeed, we can't tell you how many times we've futilely tried to dig our spoons into a copy of "Chocolate Fudge Babes" or bought a pint of Schweddy Balls and scooped it into our DVD players.

The lawsuit seeks unspecified damages and a court order requiring Caballero to “deliver for destruction” all its allegedly infringing DVDs. At press time, it was unclear how this lawsuit will affect Ben & Jerry's hotly anticipated new "Cleveland Steamer" flavor.
