Charles Nagel, Law & Order: Criminal Intent's Kathryn Erbe's #1 superfan/creepy stalker, was given five years probation after claiming he was raped in jail.
Nagel, who you might recall for that time he showed up to "visit" Erbe on set with his daughters Harley Quinn and Batgirl, penned her demented love letters, or posted pictures of Erbe's daughter on Facebook with a cockroach coming out her mouth, was found guilty of stalking the star last year and faced up to 57 months in prison.
Yesterday in court, Nagel claimed that he was raped by an inmate at the Metropolitan Detention Center in Brooklyn after he was arrested, claims the prosecutor says are false. Nagel also trotted out his two daughters to plead before Judge Jack Weinstein for their father's freedom. Weinstein ultimately concluded that the sentence was too harsh: "The defendant is a troubled person with serious psychiatric problems requiring continuing treatment and supervision," he said, adding that Nagel had already served 115 days behind bars and 380 days of house arrest. Nagel is also being ordered to pay $42,000 to cover Erbe's security expenses and emotional damage.
The Daily News notes that though Nagel told the judge he has no assets, his lawyer does admit that Nagel owns some "valuable" Batman comics, which explains so much and so little all at the same time.
