Uh oh, wait till State Senator Carl Kruger hears about this! A Polish tourist was rescued from an icy patch at the "brink of Niagara Falls" on Saturday. The AP reports that 29-year-old Waldek Kubicki "slid down a hill as he tried to retrieve a dropped cell phone." Kubicki had been stranded on an "iced-over rock formation" for almost an hour. The photograph at top shows Kubicki stranded; in the photograph at left, Kubicki is behind pulled by the rope with State Parks officer behind him. Kubicki and a friend were visited Niagara Falls for the day; Kubicki has been in Lancaster, PA to study English on a six-month program.

State Senator Carl Kruger of Brooklyn may become Enemy 1 for the gadget generation. Kruger is proposing a ban on talking on your cellphone, using your Blackberry, or listening to your iPod while crossing the street. Oh, yes. There have been two pedestrians deaths in his district (a 23 year old was killed by a car while listening to his iPod at Avenue T and East 71st Street in Bergen Beach), so banning devices that seemingly distract pedestrians in NYC - and Buffalo (!) - seems to be the answer. Kruger said:

"While people are tuning into their iPods and cell phones, they're tuning out the world around them... If you want to listen to your iPod, sit down and listen to it. You want to walk in the park, enjoy it. You want to jog around a jogging path, all the more power to you, but you should not be crossing streets and endangering yourself and the lives of others."
People are definitely distracted when they are plugged into their iPods or messaging on their cells, but what about the drivers who are just as distracted? Maybe they shouldn't be listening to the radio or music. How about we ban parents from pushing their kids in strollers? Couples walking together (they might get into fights)? Tourists who take pictures as they walk? Dog walkers? The law has infinite possibilities!

The NYPD's Hate Crimes Task Force is investigating why 28 year old black man ran into the Belt Highway, where he was hit by a car. Eyewitnesses say that two white men "struggled with" and "forced" Michael Sandy into traffic on Sunday night. Given that Sandy's race and the fact he was in Plumb Beach, a gay cruising area off the highway, the police have been investigating the incident as a possible hate crime. The Post has this account:

At about 9:40 p.m., he was confronted by two young white men, who began looking through the interior of the vehicle before Sandy ran off toward the Belt, witnesses told cops.

This has not been a good week for Shi Tzus. On Wednesday, one was mauled by a Rottweiler in a Queens park, and now, it turns out a Brooklyn dog groomer "fried" a Shih Tzu to death under a doggie hair dryer. The Post reports that 8 year old Zoe De Toro and her mom Tina dropped off their dog Phoebe at the Brooklyn Zoo and Aquarium, only to later get a call saying that their dog was dead. It seems that Phoebe overheated, and when Tina Del Toro got Phoebe's remains in a box, the box was warm. Del Toro wants to get the pet store closed, "This beautiful, sweet, loving dog was roasted. I won't be happy unless there's a vacant sign in this window." State Senator Carl Kruger is sponsoring legislation to make sure dog groomers are licensed and monitored by the state, which means groomers aren't licenser and monitored by the state? Hmm.

Gothamist imagines that Apollo was trying to get the Bohemian Beer Garden in Astoria, or perhaps the new Lee Bontecou exhibit at the MoMA Queens. We wonder what would have happened if Ming the tiger had escaped his Harlem apartment - a trip to Sylvia's, perhaps?
