Teen Sues City, Says Cops Called Him Plaxico After Shooting

A Manhattan teenager with no criminal record is suing the city for $1 million because cops arrested and taunted him as "Plaxico Burress" after he got shot in a robbery. Christian Dudley doesn't even own a gun, but that didn't matter to the officers who collared him after the Harlem mugging earlier this year. He was arrested in a Washington Heights hospital where he was waiting to get the bullet removed from the back of his knee—instead of surgery, he got dragged to the precinct on a charge of criminal possession of a weapon. And that's where the fun really started.

Sad Plaxico Can't Have Microwave In Prison

Two weeks into Plaxico Burress's stay at an upstate prison and word is that Plax is (1) always looking around him, (2) scared of his fellow prisoners, (3) hangs around another fellow high-profile inmate and (4) can't make microwave popcorn, according to the Post reporter who visited him and spoke to others at Oneida Correctional Facility.

His mugshot was released and the Daily News analyzes the now clean-shaven "somber" Burress: "The ex-Giants star was also without his standard bling - two diamond earrings... sporting a white T-shirt beneath a green prison-issued top and appears to stand a little taller than his NFL listed height of 6-foot-5. Burress is staring straight ahead, his face betraying little emotion, in the photo."

Plaxico Burress Has a Rough Start in Jail

If Plaxico Burress fans want an up-to-date jersey of the Super Bowl hero wide receiver, they're going to have to ditch those #17 duds in favor of his new number, 09-R-3260. The former Giant star left court and headed to Ulster Correctional Facility where he was given a shave and a haircut and strip searched out of the jeans he was wearing. Burress neglected to arrive at prison in the notorious sweatpants that sent him there.

Plaxico Burress Says Club Knew He Had Gun

Tonight, on ESPN's 7 p.m. E60 program, former Giants star Plaxico Burress talks publicly about his decision to take a plea deal after accidentally shooting himself in the leg with an unregistered gun at a Manhattan nightclub last November. The deal will send him to prison for two years. Burress says that the security at Midtown's Latin Quarter nightclub knew he was carrying a gun but waved in him in anyway, "It wasn't like I was trying to hide it." He also says, "Like I said, I got myself into a situation and, you know, I gotta deal with the consequences for it."

Plax Picks a Professional for Pre-Season Prison Prep

Plaxico Burress is getting ready to for his two-year prison sentence after pleading guilty to gun charges by hiring a consultant to help him maximize his time while under medium-security supervision. His lawyer Benjamin Brafman yesterday told the Post, "We are consulting with an expert in the field who will address and advise us, Mr. Burress and his family, on what to expect while incarcerated, and how to use his period of confinement as productively as possible." Michael Vick recently said he was in "the best shape of my life" after being released from two years behind bars and signing with the Eagles. A Corrections spokeswoman said, "Due to his notoriety, there is a potential that he would be placed in protective custody. And those guys are held in single cells, with the exception of a shower, a visit, a medical visit. You're only out of your cell for eight hours a day." Corrections officials will likely be reminding their guards (and chaplains) to avoid any "Foxy Brown-style" celebrity treatment for Plax. Yesterday on his radio show, Mayor Bloomberg said he was satisfied to hear that the football star will be prosecuted to the fullest extent of the law.

Plaxico Burress Pleads Guilty, Agrees To 2 Years In Prison

Former Giants star Plaxico Burress has pleaded guilty to attempted criminal possession of a weapon in 2nd degree and will server 2 years in prison, in what WCBS 2 says is a deal with the Manhattan DA's office. It sounds like a deal, since he was facing 3 1/2 to 15 years on the three charges he was indicted on—"two counts of criminal possession of a weapon and one count of reckless endangerment."

Plax's Lawyer Blames Bloomberg, Morgenthau For Indictment

With former Giants star Plaxico Burress indicted on gun charges, his lawyer Benjamin Brafman said, "Although disappointed, we are not surprised, as the facts of this case have not been in dispute since the date of the incident. When you have the mayor and the district attorney both publicly demanding a maximum prison sentence, it was perhaps too much to hope for the grand jury to conduct a sympathetic review of the unique facts of this sad case."

Plax Awaits To See If Grand Jury Is Receptive To His Plea

The Plaxico Burress case is now in the hands of the grand jury, who will decide what charges (if any) are coming against the receiver. The News reports that the end of proceedings saw three Giants staffers share their accounts of the fateful November night—Director of Development Charles Way, VP of Medical Services Ronnie Barnes and Coach Jesse Armstead. And before any decision is reached, the Times tries to sift through all of the media gamesmanship on both sides to get at just what actually would be a fair punishment for Burress. One criminal attorney familiar with the standard plea tactics of the DA's office said one year's jail time usually would have been the norm for these sort of charges (Plax's lawyer Benjamin Brafman's offer of one year was allegedly rejected by his former boss, Robert Morgenthau.) Brafman is still whining to the press about the unfairness of the DA's hard stance against his client, now saying he is "deeply saddened by (their) lack of compassion." The grand jury, acting as "the conscience of the community," could decide as early as today if they found a similar sympathy in Plax's testimony. Update: That was fast: Burress was just indicted!

Pierce Concludes Testimony Confident He'll Sack Any Charges

Giants linebacker Antonio Pierce completed his testimony before a grand jury yesterday, concluding two days recounting his involvement in the Plaxico Burress shooting mess last year. Pierce's lawyer sounded confident that the star's defense was as strong on the stand as it is on the field, recounting his testimony that he was helping "save the life of his teammate" by concealing the gun Burress shot himself with and returning it to the receiver's home after getting him to a hospital. His attorney seemed unconcerned with DA Robert Morgenthau's allusions that charges may be coming for Pierce as well, saying, "It was really clear once all the testimony came out that no one could have acted any differently." While the linebacker didn't talk to reporters, he's been all over Twitter discussing the case, saying he would "Draw a line in the Stand and see what side PEOPLE are on." Immediately after testifying, Pierce asked for directions to Giants training camp with bravado, tweeting, "Which way to ALBANY? someone just told me." Naturally the Post's Andrea Peyser was disgusted, thinking about the trip up I-87 bumping K-Ci and Jojo.

Plax Apologizes To Grand Jury and Fans

Former Giant receiver Plaxico Burress testified for three hours in front of a grand jury today, then followed his time on the witness stand with the first words he's spoken to reporters since the day he shot himself in the leg inside a Manhattan nightclub eight months ago today. Burress said, “I was truthful, I was honest and I am truly remorseful for what I’ve done, what happened and what I did. I just want to thank everybody — family, friends and fans — for their support.”

Plaxico Burress To Testify In Front of Grand Jury Tomorrow

Eight months after accidentally shooting himself in the leg (with his own gun) at a Manhattan nightclub, Plaxico Burress is going to testify in front of a grand jury tomorrow. According to the Post, his "attorney, Ben Brafman, hopes that his client can convince the grand jury assembled in Manhattan Supreme Court to forgo an indictment." Brafman said, "Mr. Burress is going to ... tell the truth about what happened that night... He's [also] going to ask [the grand jury] to believe that this unfortunate incident should not be used to ruin his life." The Manhattan DA's office, which wants the former Giants player in to go to jail, is also going to seek charges against Burress's teammate Antonio Pierce, because Pierce took Burress's unlicensed gun back to Burress's NJ home. Giants co-owner John Mara called charges against Pierce "unwarranted."

DA's Office Wants Plax Behind Bars for Years

Manhattan DA Robert Morgenthau made it clear today that his office has no plans to let former Giant receiver Plaxico Burress off lightly for the pending gun charges from his November shooting incident. The DA told the Post, "We've always taken the position that he's going to have to go to jail, whether by trial or by plea."

Is Plaxico Getting Celebrity Justice Treatment or Not?

Plaxico Burress's attorney claims that his client is getting no celebrity treatment from the Manhattan DA's Office. What's more, Plax's hotshot lawyer Benjamin Brafman suggests prosecutors should go easy on the football player after news that Browns receiver Donte Stallworth only received 30 days in jail in a DWI manslaughter plea deal.

Plax Frees Up His Summer With Plenty of Time for Camp

Plaxico Burress made his way into Manhattan criminal court this morning where a judge adjourned his weapons possession case until September. A grand jury will decide whether to indict Burress for last fall's shooting mess at nightclub Latin Quarter by September 23rd, marking the end of any potential plea deal trying to be worked out by his high-profile lawyer Benjamin Brafman. Brafman said, "There is no victim in this case besides Plaxico Burress."

Plax Lawyer Pushing for a Delay of Game

Plaxico Burress is due back in court Monday for the first time since getting his case postponed in March. Since then, his lawyer Benjamin Brafman has been attempting to hammer out a deal with prosecutors. But it appears that the attorney hasn't quite found the magical offer to beat Plax's gun charges the way he once did for Diddy. Brafman told the News, "We'll be in and out of court in five minutes. There is going to be an adjournment. There is no agreement at all." Brafman says that he hopes that the case can be put off until September, possibly opening the door for the receiver to step on the field this season. The Post continues to float the notion that the Jets might still be interested in Burress, along with the Bucs and the Bears, but shockingly no mention of the Dallas Cowboys.

Jets Holler at Plax Just to See What's Up

You know when you watch a buddy of yours get his life turned upside-down by a psycho girlfriend and then you hear everyone congratulate him on doing the right thing once he finally mans up and tells her to hit the road? But then one night a month later, you realize how lonely you are and can't stop thinking about how how great he'd always said the sex with her was. So you find yourself visiting this chick in rehab, telling her to give you a call if she ever needs a place to crash. No? Well that's what the Jets did a few days ago when GM Mike Tannenbaum placed a call to agent Drew Rosenhaus checking in on the status of Plaxico Burress. When ESPN first reported it, the Jets first gave no comment (caught) and then the GM said, "Consistent with our normal approach of performing our due diligence, we contacted (Rosenhaus) several days ago prior to the draft to inquire about Plaxico's pending legal situation." Plax Makes the Giants Pay Yet Again

Despite no longer being a member of the team, Plaxico Burress still has a one million dollar check signed by the Giants coming to him after a ruling today. The NFL's special master ruled that the Giants will have to pay the final million of Plax's $4.25 million signing bonus that the team tried to withhold in December, two weeks after his shooting incident that caused the team to suspend him for the rest of last season. Union lawyers for Burress argued last week that the shooting did not constitute a "willful" attempt to default on his contract. The Giants now have to undergo another arbitration case over whether their four-game suspension was "excessive" in an attempt by Burress to recoup the salary he lost as a result. The NFL thinks today's decision illustrates "a serious flaw in the current system" and said, "When clubs pay upfront bonuses as part of a long-term deal, they do it on the assumption that the player’s ability to play will not be limited by his own unlawful activities.”

Giants Release Plaxico Burress From Team

The NY Giants have released Plaxico Burress from the team today. The star wide receiver, who played with Big Blue for four seasons, is currently trying to negotiate a plea deal with the Manhattan DA's office, as he faces felony charges for accidentally firing his illegal gun in a Midtown nightclub. Though some have thought the Giants should have cut him right after the November incident, Giants GM Jerry Reese said today, "I am an optimist, and I believe most situations can be worked out. We hung in there as long as we could in hopes that there could be a resolution to this situation other than the decision we made today to release Plaxico. It wasn't to be, so now we have to move on. Like everybody else here, we want nothing but the best for Plaxico, and we are appreciative of the contributions he made to this franchise."

Plaxico Burress Gun Case Adjourned Till June

Giants wide receiver Plaxico Burress arrived at criminal court in lower Manhattan this morning and both the Manhattan DA's office and Burress's lawyer agreed to have his gun case adjourned until June 15. Burress remains free on $100,000 bail.

Jail Time Might Be Included In Potential Plax Plea

While last week's talk of a possible plea deal for Plaxico Burress was to keep the Giants wide receiver out of jail, today's NY Times reports, "it appears likely that any agreement would require him to serve at least some time behind bars." Burress found himself with a load of legal problems—and a gunshot wound in his thigh—after he accidentally fired his illegal gun (it fell down his track suit pants) last November while at a Midtown nightclub. The Times further explains that prosecutors "commonly offer reduced charges in gun possession cases, taking into consideration things like a defendant’s criminal history," and in Burress's case, it was his first offense, it seemed to be an accident, he was the only one injured, and he's been cooperating with the authorities. (He did not have a NYC permit for the gun; he did have an expired Florida permit.) Burress is due in court tomorrow; it's unclear what the Giants will do, but Newsday's Bob Glauber says the team "needs to proceed as if Burress is gone."

Will Plax Plea Before Court Appearance?

With less than 72 hours until Plaxico Burress is due in court to face weapons charges for his infamous shooting incident last fall, reports are coming out that his lawyer Benjamin Brafman is doing everything he can to strike a plea deal to keep the Giants' receiver out of jail. Brafman, famous for getting Diddy off a weapons rap ten years ago, "has been in constant communication with the Manhattan district attorney's office for months," according to ESPN. The Giants are watching patiently and seem to be open to a Plax return if charges are reduced. In the meantime, the team has refused to let him take part in their voluntary offseason program. Until the court date though, don't expect any more leaks from the tight-lipped Brafman—who the Star-Leger calls "the Patriots of attorneys." And Tuesday is lining up to be a star-studded day in criminal court, with rapper Ja Rule and Real Housewife Kelly Bensimon all scheduled to have hearings back to back.

Giants' Jacobs: With Plax, We'll Be in Super Bowl XLIV

Giants running back Brandon Jacobs, who will be a free agent, said he plans on being back with the team next season—and promised big things if Plaxico Burress is re-signed as well. Repeating a refrain he had after the Giants were kicked out out the playoffs, Jacobs said, "If we have Plax on our team, we go 15-1 and we win the Super Bowl. I'm not afraid to say that, and I'll say it to anybody on any team." He's not sore about Burress's off-field actions, either, "You can't judge him for what happened because no one really knows what goes on out in those streets. A lot of people don't know anything about what happens or how targeted we are. The guy's not a criminal. He shot himself, he didn't shoot no one else and I think they should get off of his case and [he should] be able to continue his career."

DA's Office May Be Gunning for More Plax Charges

Giants receiver Plaxico Burress may be in further trouble with the law now that the Manhattan DA's office has opened a probe into whether the guns that were seized from his house following the shooting mess he got himself into this fall might be connected to shots that were fired in 2005 out of a car that Burress was renting. The Chevy Avalanche in question was seized after Burress' cousin and another man had fired off shots when the vehicle got stuck behind a garbage truck in The Bronx. Burress was cleared of any culpability, but now authorities will see if the guns involve match any of Plax's. Plaxico was in court this week in Pennsylvania where he was cleared in a lawsuit for damages to the Avalanche which had been loaned to him by a dealership in exchange for signing autographs at promotional events. The Giants are still debating if they want Plaxico back next year—maybe recent whispers of TO coming to town might be enough to soften the blow of the Giant Super Bowl hero's return.

     

The reign is over. After falling to the Philadelphia Eagles yesterday in the divisional playoffs, the Giants fell to the task of trying to make sense of how the game—and the season—slipped away from them.

Giants Wide Receivers Do Go to Applebee's

Just weeks ago, Giants wide receiver Plaxico Burress shot himself in the leg while at a Manhattan nightclub, but, when he was being treated at a NY hospital, he allegedly claimed his name was "Harris Smith" and said he was shot at an Applebee's. Now, it turns out that Burress's replacement on the field, Domenik Hixon goes to Applebee's. A NJ.com reader posted a photograph of himself with the player and NJ.com's John Shabe writes, "Seems like Hixon was a pretty good sport to mug for a photo with these guys." Hixon will be working off those Applebee's calories when he and the Giants face the Philadelphia Eagles in next Sunday's NFC divisional game.

          

After cops from NJ and NYC raided the NJ home of Giants star Plaxico Burress and found two guns and ammo, his lawyer doesn't think his client will face more charges. Attorney Benjamin Brafman said, "We believe the paperwork will check out and show any weapons were lawfully purchased by Mr. Burress and lawfully registered," but the Daily News reports that "investigators found gun licenses at the home, but have not been able to match them to the seized weapons." If Burress is arrested in NJ for illegal gun charges, his bail from the "accidental shooting at a Manhattan club" incident could be revoked.

Yesterday morning, authorities from NJ and NY raided the Totowa, NJ home of Plaxico Burress and found a "small cache of weapons and ammo." The Post reports, "If the guns are unlicensed, the embattled wide receiver could face additional charges in New Jersey on top of the felony gun-possession charges he was slapped with after shooting himself in the leg at a Manhattan nightclub last month."
