Trustee To Sue Madoff's Relatives For Ill-Gotten Gains

Irving Picard, the trustee who is liquidating whatever can be found of Ponzi king Bernard Madoff's fortune for in order to repay his thousands of victims, says that he's going to sue Madoff's two sons, Mark and Andrew, as well as his brother Peter and niece Shana, noting that they made $150 million over the years. All four were employed at Madoff's firm and Picard said he'll sue them for negligence and breach of fiduciary duty, "Whether or not they have a criminal problem we will pursue them as far as we can pursue them and if that leads to bankrupting them, then that's what will happen." more ›

Lawyer: Madoff's Brother Can't Afford To Take Subway

A lawyer for Peter Madoff, brother of admitted multi-billion dollar Ponzi man Bernard Madoff, tried to get a NY state appeals court to overturn the freeze on his assets. Peter Madoff worked for brother Bernie's investment firm, but has not been charged with any wrongdoing (though the fed are investigating). His lawyer said, "My client can’t spend a dime, he can’t take a subway ride, he can’t buy a loaf of bread, pay his attorneys." Well, maybe he should have looked a little closer at his brother's business goings on! Bloomberg News reports that today's attempt revealed Peter Madoff agreed to a "voluntary" asset freeze in December: He was given "$10,000 a month for expenses... allow[ing him] to pay his mortgage and required him to provide prosecutors with a receipt for any purchase of more than $150." Ultimately, though, the court decided today to keep the freeze on Peter. more ›

Judge Freezes Assets Of Madoff's Brother

Yesterday, a judge agreed to a Brooklyn Law student's request to freeze the assets of Peter Madoff, brother (and employee) of admitted multi-billion dollar Ponzi schemer Bernard Madoff. Peter Madoff oversaw Andrew Ross Samuels' $480,000 trust fund, which was created in 1997 by Samuels' grandfather who worked for Bernard Madoff. Upon his grandfather's death, Peter Madoff was made the trustee, but of course that disappeared when the scam was revealed. Samuels' father of Peter Madoff, "He's either incompetent or in cahoots." Samuels is suing for breach of fiduciary duty—as well as his trust's money plus $1.5 million in damages—to which we say, that sucks, but get in line. more ›
