The Manhattan DA's office has dropped charges against an Occupy Wall Street protester just as the protester's attorney was poised to subpoena Deputy Inspector Anthony Bologna. Marisa Holmes was videotaping Bologna discharging pepper spray into a group of protesters when she was charged with obstructing governmental administration. "I would have loved to see 'Tony Baloney' on the stand," Holmes told the Daily News. Yesterday one of the nation's longest running "Occupy" encampments was evicted by police in Albany, the capital of the Empire State. After two months in a park across from City Hall and the Capitol, the Department of General Services workers and city policy notified protesters yesterday afternoon that a court order had given them the authority to remove them. As a group of demonstrators angrily shouted in protest, workers took down the tents until just one large tent (the "info tent") remained. After a standoff, at least 50 occupiers seized this tent and paraded it through the city, then, as night fell, returned to the park for a final showdown with the cops. more ›

A 15-year-old girl allegedly pepper sprayed over a dozen people in the cafeteria of a Bronx high school today, shortly before 1 p.m. The NYPD press office didn't have any information for us about the incident, but a source tells NBC New York that 15 students were treated at the scene and about four to five were taken to the hospital. Did actor Roberto De Niro have his driver do his dirty work for him? According to the NY Post, his driver Vladimir Labissiere pepper sprayed a TMZ videographer earlier today at LaGuardia Airport after he had filmed the actor. This took place just before 11 a.m. in the Delta Terminal, but reportedly De Niro had already passed security and didn't witness the incident, which began with some verbal sparring. Labissiere managed to hit not only his target with a dose of the spray, but a passerby as well; he fled the scene immediately and the NYPD are trying to track him down to question him about the incident... which we assume is all on tape and will be hitting TMZ any minute now. more ›

Suffolk County police arrested a woman for pepper spraying a cab driver who had driven her from Manhattan to Melville, Long Island. According to 1010 WINS, "Amina Williams, 22-year-old woman from Redwood City, Calif. arranged for the cabbie, Alexandre Oseimensuo of New Jersey, to drive her from Manhattan to Melville, Long Island" and "agreed on a fare of $150." However, once in Melville, she only offered $80—but Oseimensuo wanted the full fare. Then Williams allegedly sprayed him with pepper spray. The East Fordham Road building, which houses a number of schools, was evacuated in an apparently confusing manner. Three Separate Pepper Spray Incidents at Schools

It was the trifecta when the FDNY responded to three different schools where pepper spray had been released. NY1 has the rundown: The first was at A. Philiip Randolph Campus High School in Harlem. It's unclear what the circumstances were, but one student was taken to a hospital with chest pains while 16 others had burning eyes and itchy throats. The second was at a Chelsea high school, where a "14-year-old sprayed pepper spray in the cafeteria"; five students were taken to the hospital for treatment and the 14-year-old was arrested. The final one was at St. Francis Prep in Queens, where a "student claimed it fell out of her purse and discharged." She was taken into custody as 11 people were taken to hospitals. more ›
