Just a day before the running of the NYC Marathon, the U.S. Olympic trials for the men's marathon were marred by an untimely death today. 28-year-old Ryan Shay died while competing in the Olympic trials in Central Park, just a few miles into the 26.2 mile race. It was an enraged fellow spin class member that knocked him and his exercise bike into a wall at the Equinox Gym on East 86th St. in August, but now it's Stuart Sugarman who is very angry!

Last week, debate about gym etiquette went to a new level after news of a spin class altercation. When one spinning class member was too loud (war-whooping, hollering, grunting), another member threw him and his bike against a wall at an Upper East Side Equinox location. The grunting member, 48-year-old hedge fund manager Stuart Sugarman, suffered a concussion and spinal injuries and now he tells the Post about the latest injustice he's suffered.

Earlier this month, New Yorker Nicole Carey gave birth at Lenox Hill Hospital - a posh, private hospital on the Upper East Side where many a celebrity has gone for treatment when in town. But the Long Islander's hospital course went awry when her brand new son Preston's brand new lungs filled with fluid and she herself developed blood clots in her uterus. Preston was taken to the intensive care unit immediately where he would still be a few days later when mom was discharged home.

Brooke Astor's son, Anthony Marshall, finally spoke out about his family drama. Last week, Marshall's own son, Philip, had charged that his father was mismanaging and neglectful of the 104 year old grand dame's care, asking that new guardians be appointed. Astor was moved into Lenox Hill Hospital for observation, and Anthony Marshall told reporters that he does care about her and has been a thoughtful guardian. (His son's affidavit claims his father skimped on medication and buying Astor clothing - and making her sit in a couch smelling of dog urine). Anthony Marshall's wife Charlene said, "Not everyone has a Park Avenue apartment. Not everyone has eight servants." Hmm, that is a good point, though it's Brooke Astor's money, so she can spend it however she wants. At any rate, Marshall added, “I was very touched and encouraged by the fact that my mother’s present state of age has brought attention to the need for care of elderly people. My mother always liked to spearhead a problem, whether it was within the New York community or throughout the nation. I’m happy she can still do what she did for years for the foundation, even if she doesn’t know it.”

The scandal over whether or not 104 year old philanthropist Brooke Astor is being denied a decent life by her son hits all the papers today. It turns out that Astor, whose grandson, Philip Marshall, accused his father, Anthony Marshall, of skimping on Astor's medical treatment and basic needs, has been taken to Lenox Hill Hospital for treatment, and is "improving" (overall, we suppose?). Neither Marshall has commented, but Anthony Marshall's friends deny that he's capable of making his mother sit in a urine-smelling couch and tatty nightgowns - he fought in World War II, was a CIA operative, and is now a Broadway producer. However, one of Astor's employees told reporters as she left the Park Avenue apartment building, "I think it’s great that the truth has finally come out." The Daily News, who broke the story, has five articles today, from explaining the history of the Astors to why she matters to New Yorkers.

An 18 year old upstate girl in the city for a New Year's party at the Carriage House Bar on East 59th Street was raped in the bathroom. According to the police, she blacked out during the party and found herself in a bathroom having sex; Newsday reported:

The bouncer at the bar, the Carriage House Bar on East 59th Street, broke up the attack, apparently mistaking the rape for consensual sex and telling the 18-year-old victim and the suspect to put their clothes back on, police said. The victim, who is from Saratoga Springs upstate, left with a male friend, who took her to Lenox Hill Hospital. The friend then returned to the bar, where the suspect was still partying. The friend confronted the suspect, who shoved the friend and ran off, police said.
The Post actually have a photograph of the Carriage House Bar bathroom and adds that the victim was not only drunk but high on coke as well as a "college preppy" who arrived with other friends in a limo. The bar's owner Hamid Izam tells the Post that he thought the party's organizer was over 21 and was told that all the attendees would be over 21; Izam was given a citation.
