One of the Zyrtec thieves accused of striking and killing Errol Morris editor Karen Schmeer has been identified. David McKie, a 25-year-old from Brooklyn, told police that he was in the getaway car that collided with the Fog of War editor on the Upper West Side Friday night, but claims he wasn't behind the wheel. The driver and one additional passenger are still at large, while McKie—who'll take the stand on Thursday—faces 25 years to life. "My son is not a murderer, and he is deeply sorry," his mother told the Daily News, through tears.

Film Editor Killed by Rx Robbers Had "Immense Talent"
Karen Schmeer, the longtime Errol Morris editor who was hit and killed Friday night by a frenzied getaway driver, has been called “one of the greatest editors of her generation.” The industry professional, who edited "The Fog of War" and many other documentaries, was crossing W. 90th Street yesterday when she was struck down by a car fleeing from the police. Its driver and passengers had just robbed over-the-counter allergy medicine from a local CVS, and fled on foot from the scene of the accident with cops giving chase.

7:06PM First thoughts: Gael Garcia Bernal is so cute. Ryan Seacrest is an idiot, as are Joan and Melissa Rivers. But we want to know what Jennifer Lopez is wearing! (It turns out to be Marchesa.)
Howard Beach Hate Crime Trial Begins
The hate crime trial of Nicholas Minucci, aka Big Nick, began yesterday at the State Supreme Court in Queens. The Queens DA's opening statment argued that Minucci and his friends wanted to intimidate and injure Glenn Moore because he was black, while Minucci's defense lawyer Albert Gaudelli said their dispute was "minor dustup between six young men," especially since Moore and a friend were in the neighborhood to steal. Gaudelli also called the 19 count hate crime trial a politically motivated attempt to bolster black support for Mayor Bloomberg right before reelection. There's a lot of media attention on this case, so much so that the judge had to tell the courtroom "it's not Yankee Stadium, or the movies."
The Gates, Ensnowed
Christo and J-C's own site about the project, and New York magazine's feature about The Gates. And we wonder what the weather will be like once The Gates are up - will the fabric stand up to blizzards? And speaking of gates and dogs, there's this great Errol Morris documentary about a pet cemetery: Gates of Heaven.

I would say that almost all the interviews-- 95% plus --focus on McNamara, and not on the film as a film.

Mystic River and the New York Film Festival
If it's fall, it must be time for the New York Film Festival. This year, the opening night film is Mystic River, the ensemble drama directed by Clint Eastwood. The cast is ridiculously loaded with great actors: Sean Penn, Kevin Bacon, Tim Robbins, Laura Linney, Marcia Gay Harden, and Laurence Fishburne. The story is dark, eliciting comparisons to Eastwood's tour de force western, Unforgiven, but its present day setting makes it more wrenching. Sean Penn also stands a good chance of being nominated come Oscar time, based on the buzz of his performance as a father whose daughter is murdered.
