In 2001, an off-duty police officer who spent up to 12 hours drinking before going to his Brooklyn precinct struck and killed a 24-year-old pregnant woman, her 4-year-old son, and her 16-year-old sister. Medical staff delivered the woman's baby boy, who died 13 hours later, and police officer Joseph Gray was eventually convicted of four counts of second degree manslaughter. He was sentenced to 5 to 15 years in prison and yesterday, after 10 years behind bars, Gray was released.

A pedestrian was struck and killed yesterday in Harlem by an off-duty NYPD maintenance worker. According to police, 57-year-old Victor Felix was hit by an Acura heading northbound on 7th Avenue/Adam Clayton Powell Jr. Boulevard at 146th Street around 9:30 p.m. Felix was taken to Harlem Hospital, where he was pronounced dead.

Sources tell the Post that Urena told officers he was aware of the BAC monitoring device: "Yeah, I know what it is; I'm a Bronx assistant district attorney."

A 5-year-old boy who was critically injured in a Saturday morning automobile accident on the Sunrise Highway has died of his injuries. Newsday [paywall] reports that John Gaffney was riding with his family in a Dodge dual-cab pickup truck driven by his father, Kevin Gaffney, 36, of West Islip. Gaffney's wife, Teri, a daughter, 7, and another son, 2, were also in the truck when it was rear-ended by Steven Kinalis, 30, a Ronkonkoma resident whom police say was high on drugs.

A Long Island man crashed into a cop car around 2 a.m. this morning and was charged with DWI. As you can see from his mug shot, 22-year-old Kevin Daly is one of the many proud Americans who are "owning it," at a time when more of us should really be renting. Yes, Daly was arrested wearing a T-shirt that reads "I'M NOT AN ALCOHOLIC. I'M A DRUNK. ALCOHOLICS GO TO MEETINGS." What makes this story seem even more contrived is that the cop car that Daly hit was part of a special drunk driving unit, the Suffolk County Police Department’s SAFE-T (Selective Alcohol Fatality Enforcement Team) Section. It seems SAFE-T officers don't really have to go out of their way to bust drunk drivers on Long Island.
Unlicensed Driver Kills Pedestrian, Gets $500 Fine
In July, a driver with a suspended license was quickly backing up on Amsterdam Avenue to score a parking space when he ran over two women crossing the street at West 98th Street. Yolanda Casal, 78, was pronounced dead at the hospital while the other woman, her 41-year-old daughter Anais Emanuel, was hospitalized with injuries. Shortly after the incident, a witness told the Post, "They had the right of way and that guy just kept backing up. He was trying to get that spot." Now Streetsblog reports that the driver, 38-year-old Edwin Carrasco of Paterson, New Jersey, did not get off scot-free—he'll have to pay $500 as punishment.

New York Public Library president Anthony Marx was charged with DWI, DUI and operating a motor vehicle while impaired after "he sideswiped a parked vehicle with a... car registered to the library," yesterday afternoon, Metropolis reports. Police say that Anthony Marx had a blood alcohol level of 0.19, which is more than twice the 0.08 legal limit.

A former chief fire marshal for the FDNY has allegedly been granted a generous plea agreement for a DWI charge he incurred in December. Louis Garcia, who the Daily News calls a "legendary FDNY figure" before his retirement in 2008, allegedly ran a stop sign near his home in Whitestone and crashed his Mercedes into an unmarked police car.
Doctor Arrested For DWI Twice In One Weekend
Dr. Susana G. Duncan allegedly had herself a helluva weekend at her second home in Columbia County. Duncan, a sports medicine doctor whose primary residence is on Park Avenue here in NYC, first ran afoul of the law on Saturday, when she called police to report that her 2004 Volkswagen had been stolen. But cops quickly closed the file on that one after they located the vehicle on Duncan's property, crashed down a large embankment, NBC New York reports.
New DWI Law Would Require Alcohol-Sensing Anklets For Scofflaws
Convicted drunk drivers may not be able to merely scrap their cars to avoid an ignition interlock breathalyzer and the long arm of the law. A new bill would require those convicted of DWI who don't install the devices to wear alcohol-detection anklets. The bill comes after Daily News reported that only 21% of those recently convicted of DWI in the city install the mandatory devices. A third of DWI-convicted drivers statewide comply with the law. "We believe many of them feel they can simply wait it out for six months," Nassau County DA Kathleen Rice tells the paper.
Bronx DA Gets First Conviction In Case Involving Ticket-Fixing
Bronx prosecutors have won their first case involving a ticket-fixing cop. Leonardo Coronado was convicted of DWI yesterday despite his attorney grilling arresting officer Richard Urbina about tampering with summonses. According to the Daily News, Urbina admitted to the judge that ticket-fixing was a "breach of his oath," but called the practice a "common courtesy" that he performed for his father and two cab drivers.

The accident occurred around 7 p.m. at the sleepy intersection of Leonard Street and Meserole Avenue, and witness Sheryl Yvette tells us the driver also hit a livery cab minivan at the intersection. A driver who killed one motorcyclist and severely injured another in 2008 while he was on PCP agreed to an extremely favorable plea bargain that would have him serve just two to six years in prison. DNAinfo reports that 34-year-old Adam Greenberg pled guilty to aggravated vehicular manslaughter, vehicular assault, and DWI in exchange for the sentence, which was light because police in an impound lot destroyed his Volkswagen Jetta before his defense team could analyze the vehicle for mechanical issues. "Your conduct in terms of the outcome was not intentional, but your acts were really outrageously reckless," the judge told Greenberg at his sentencing yesterday.
Allegedly Drunk Off-Duty Cop Fatally Strikes Pedestrian
An off-duty cop has been charged with killing a man while allegedly driving drunk early Wednesday morning in the Bronx. According to police, rookie officer Luis Arnao, 25, struck Tyre Chisholm, 22, with his 2011 Honda Accord as Chisholm was crossing the street on White Plains Road near 241st Street just before 4 a.m. "He got hit hard. He flew up in the air. His shoes flew off with his socks still in them," said witness Devine Douglas.

The former Bronx Assistant District Attorney who is charged with DWI after an accident on the Major Deegan Expressway has dismissed her attorney and has hired a defense lawyer who successfully argued in favor of a different Bronx ADA's DWI. Another possible reason why Jennifer Troiano ditched lawyer Howard Weiswasser: He's her best friend's dad, and since her best friend is another ADA who is supposed to testify...which means he would have had to cross-examine his own daughter.
Off-Duty Cop Killed By Allegedly Drunk Driver On LI Highway
New York State Police say that an off-duty NYPD officer was killed when a drunk driver rear-ended him. Kevin Jessup, 25, had been driving east on the Southern State Parkway when Jonathan Lopez struck his car around 5:35 a.m. yesterday morning. Jessup was pronounced dead at Nassau University Medical Center, while his passenger, Crystal Simons, was released after being treated for non-life-threatening injuries.
ACLU Director's DWI Hushed Up By ACLU, With Help From East Hampton Police
A police source tells the NY Post they "inadvertently" omitted Romero from the weekly press package. Given the ACLU's often adversarial relationship with police, it's not immediately clear why they'd do anybody at the ACLU any favors. But the ACLU's reticence on the incident raised eyebrows. Wendy Kaminer at The Atlantic writes, "You might expect an organization advocating for government transparency (including a transparent criminal justice system) to consider a DWI charge a public matter; you might even expect the ACLU Executive Director to inform national board members of his drunk driving charge and pending court date. But... Anthony Romero has a history of keeping secret his own embarrassing or wrongful behavior."
Cop After DUI Arrest: "I Had A Couple Of Beers"
An NYPD sergeant was charged with a DWI after he ran a red light at Garnet and Court streets in Brooklyn early this morning. The sergeant, 34-year-old Diego Vivar, was off-duty, and not bashful about what he had done: "I had a couple of beers," Vivar told the Post. "There were no injuries and I didn't have my firearm on me," he adds. Oh well when you put it that way...
