Sexual assault charges against Dominique Strauss-Kahn were dismissed yesterday because, as the prosecution put it, "If we do not believe her beyond a reasonable doubt, we cannot ask a jury to do so." Now, because of her lies to a grand jury, the prosecution, and the federal government, it's possible that Nafissatou Diallo will face deportation hearings. "Lying on sworn statements is almost a guarantee the case will be reopened," one lawyer tells the Daily News. Another immigration attorney says, "With all the press attention, my educated guess is that they are going to look at her case again."

Dominique Strauss-Kahn won't have to show up in court until August 23, as the hearing scheduled for August 3 has been postponed by the DA's office. That August 3rd hearing was postponed from July 18 as both legal teams continued to investigate the sexual assault allegations leveled against the former IMF head by Nafissatou Diallo. "We understand the district attorney is continuing to investigate," Strauss-Kahn's lawyers said in a statement, "We are confident that when the investigation is completed Mr. Vance will move to dismiss all charges." City Room reports that Manhattan DA Cyrus Vance Jr. would soon issue a statement explaining the delay.

Now, a "top investigator in the case" tells the Post it is "a certainty" that the case will be dismissed, noting, "We all know this case is not sustainable
She is not to be believed in anything that comes out of her mouth." The source continues: "Did [Strauss-Kahn] use force? Was there actually a crime? I don't think we'll ever know."
Why Cy: Things Get Worse For Manhattan DA's Office
Five weeks ago, a jury found two police officers not guilty of raping an intoxicated woman. Earlier this week, two men on trial for manslaughter for the deaths of two firefighters at the former Deutsche were acquitted. And on Friday, prosecutors admitted that there were credibility issues with the woman who accused international political figure Dominique Strauss-Kahn of sexual assault. Defense lawyer Gerald Shargel said of Manhattan DA Cyrus Vance, "I have enormous respect for Cy as a prosecutor, but this is like a series of bad dreams."

Doc Accused Of Falsely Diagnosing Patients With HIV In Medicaid Scam
A Washington Heights doctor faces up to 15 years in prison for allegedly running a $700,000 scam in which he falsely diagnosed his patients with HIV in order to fraudulently bill Medicaid. Suresh Hemrajani, 57, was arraigned today on felony charges of grand larceny, fraud and falsifying business records. According to Manhattan DA Cyrus Vance, Hemrajani would immediately prescribe medications for the patients on their very first visits, and send the bill to Medicaid. The investigation is still ongoing, but prosecutors believe that the patients participated willingly in the scam.
Cops Collect $4 Million of Columbia's Cash
Last month cops busted a Columbia employee, George Castro, after he allegedly siphoned $4+ million of the university's cash into a private bank account. Though Castro pled not guilty yesterday, that doesn't mean the police stopped looking for the missing loot. And they didn't have to look far. Less than two days after Castro's arrest the Manhattan DA's Cybercrime and Major Economic Crime bureaus say they had not only identified the banks where the crook was keeping his cash, but were able to seize and freeze a good $4 million of it. "We got to him quickly before the money could be dissipated," Manhattan DA Cyrus Vance told the Post.

Manhattan District Attorney Cy Vance is one of the most powerful prosecutors in the country, but yesterday he was in criminal court, trying to help his underlings get through a backlog of over 16,000 cases. According to the NY Times, "Such a backlog leads to significant delays: Last year, the average case in criminal court took 316 days to go from arraignment to completion, he said. The logjam also results in the dismissal of thousands of cases each year that fail to proceed to trial quickly enough. More than 4,800 such cases were dismissed last year in Manhattan, according to court records."
Manhattan DA Dems Debate, Cocaine Use Admitted!
The three Democratic Manhattan DA candidates debated yesterday on NY1, and immediately Leslie Crocker Snyder criticized Cyrus Vance, saying the choice was "between someone who stayed in New York during the terrible times of the ’80s and ’90s and someone who left. Cy Vance decided to move as far away as he could. (Vance moved to Seattle.) She also accused Vance of being part of an "old boy's network"—he is endorsed by outgoing DA Robert Morgenthau—and slammed him for using the term "temperament," "If you recall the recent confirmation hearings of Sonia Sotomayor, who is a strong woman and a strong judge, and I like to think like myself, a strong woman and a strong judge, and self-made, like me.” Vance said of Snyder, "Let’s have someone who can come to the debate and talk about the policy questions that are in front of us, talk about the future of the office and try to spend less time demeaning the other candidates in the race." He and Richard Aborn also admitted to using cocaine over 30 years ago; Aborn told the News, "Just because I tried cocaine once or twice doesn't mean other people should."
