Greg Kelly Still Hasn't Spoken To Investigators, Which Is Totally Normal?

020212kelly.jpg A layman might think that when somebody gets accused of rape, one of the investigators' top priorities would be to interview the suspect, to get his side of the story on record. But it seems this is not the way it works, at least not for Greg Kelly, a local TV news host and son of the NYPD Commissioner. An unidentified woman filed a complaint against Kelly more than a week ago, but investigators have still not spoken to Kelly, whose attorney says he's innocent.

"Here, in America, you don't have to explain yourself," defense attorney Edward Mandery, who represented Franklin Mata, a cop accused of rape last year, tells the Daily News. And Gerald Shargel, who once repped John Gotti, says, "Lawyers don't march their clients in to get brow-beaten by prosecutors like we see on 'Law & Order.'" Still, doesn't it seem odd for a guy to get accused of rape and not be questioned? One attorney tells the Post that while it would be "unorthodox" to let a client be interviewed before charges were filed, in this case it might not be a bad idea, since Kelly is "articulate" and has his career to think about.

On the other hand, anonymous sources have been doing a pretty swell job of portraying Kelly's accuser as an unreliable woman who cheated on her boyfriend and may have concocted the rape story after she got found out. Sources tell the Post today that the DA investigators "are skeptical of her claim and are leaning toward not charging him — mainly because of a three-month lag in reporting the alleged rape, and because of sexual text messages the duo exchanged before their fateful date." And just to reiterate: Kelly has not been charged with any crime.

  • Mr. Kelly has probably been legally advised, having already presented the prosecutors office w/ his account and evidence of a friendly relationship past the date of her allegation, to stand firm on that alone so to not initiate any more statements which could be manipulated by the prosecution and made public (sexual practices, private life). Basically, he said his part and the woman's story is falling apart. Mr. Kelly doesn't have to do any more than he already has done. Had there been anything concrete he would have been an indictment already.

  • Wait, his lawyer is a...Professional Rape Defense Lawyer?  Jeez, can you imagine what a slimeball that guy must be?  I mean, there is that whole ethical struggle in defense law-- "what if the person I am arguing for is guilty!  What if I get a guilty person off!  But...that is how the legal system works!  I have to do my utmost to get them off, that is my duty!"-- but taking it to being the person who defends potential rapists?  Who...I mean...rape convictions are like shooting stars, you have to get lucky to see one...which means that you've GOT to know that a huge chunk of your clients are guilty of some heinous stuff.  Yikes.

  • The rape apologism that is coming out of this case is *stunning*.  I've been following it from the UK. So far I've seen three stories
    1. He's been reported for rape
    2. Leaks are coming from the police which are hampering the investigation
    3. More leaks are coming from the police which are risking a successful prosecution.

    This is a *massive* story of crime and corruption - he is well known anchor on a major news corp, Daddy is the chief of police of a force that lets off its own with rape and cant manage to prosecute the rape of a hotel cleaner with bloody obvious forensic evidence.

    Only thats not the story thats being told now, is it?

  • think alot of you are closed minded and all to GO WOMEN. On this on this woman did a injusticed to the real women of the world that did get rape. And I 100 percent agree that she only cried rape because she got caught cheating. Before you go judging on how they are handling the case you should  really review the facts. Every statement that all the news reports have reported are directly her statements. And if you just read her statements, you cant sit here and be on your high horses telling me that it isnt a lie. They are keeping it low profile because it is over whelming a lie. ANd the fact she even said the Words RAPE. that will be connected to his name for the rest of his life. Even if they decided never to  file charges or do and find him not gulity. He will ever be known as an Accused rapest. It disguisting and a misuse of our system.

    All because she got caught cheating.........

    The rule is: shut up and lawyer up.

  • You are not required to tell the police anything. Criminal defense attorneys who are even halfway competent will advise you not to cooperate.  If the state wants to make a case against you, you don't need to help them.  There's an old Sicilian saying, "Silence is a friend that will never betray you."

    The fact that a condom was not used (the woman got pregnant) makes it look like it was NOT consensual, even if the women had planned to have sex with him.   Planned sex with strangers usually means you prepare with condoms.   Hard to believe it was consensual if there was no condom.

    Is she Catholic?  Is he Catholic?  You know how those Catholics are.  The can fornicate and commit adultery as long as no condom or other form of contraception is used.

    Fact is, some people do have sex with strangers without condom use. And, fact is, pregnancy can result even when a condom is used.

    Her pregnancy (even assuming that it was a result of that particular sexual encounter) certainly does not support a leap to "the fact that a condom was not used"

    Just like sexting two days before you meet up does not mean that she wasn't raped. Fact is, most women are raped by people they know.

    It's an amazing logical leap, isn't it?  

    They had sex, she got pregnant, so naturally she was raped.
