3 Months In Jail For Man Who Stashed 10 Pounds Of Weed At Daycare Center

101911stash.jpg Sherwin Rogers faced up to 15 years in prison after pleading guilty in April to first-degree marijuana possession, but yesterday he was sentenced to just three months in jail. Considering the circumstances of his arrest, one might say he got off easy—after a shootout at the Special Moments Day Care in East Flatbush, police found 10 pounds of weed that Mr. Rogers had stashed in the basement. For those moments when he needed a special time out.

Police were tipped off to the stash after being called to the scene of an armed robbery at Special Moments in 2009. After a shootout with police, the arrested robbers told cops all about the treasure in the basement, and the next day investigators returned and discovered that the center was doubling as a drug den. In addition to the reefer, they found $100,000 in cash, which can buy a lot of Pogs. Kids today are crazy about Pogs, amirite?

Yesterday, the Post reports, Rogers's lawyer pleaded with his judge to delay the sentencing because those same robbers were threatening his clients’ wife. But the judge had already granted several delays, and ordered Rogers jailed immediately, saying, pointing out that the deal was already "very generous indeed." Rogers, for his part, admitted that his "judgment was poor and terrible." Maybe next time he's sitting on a nice brick of weed he'll remember that sharing is caring.

    Joke sentence?  The courts finally get something right by not putting away a non-violent offender of a measly crime, and you call it a joke.  What are you smoking?

    Yup.  Now, if he had touched the children in an inappropriate manner, that would be a real crime.

    By stashing so much valuable marijuana and cash  in the basement of a daycare center, how could he not be endangering the kids? People who rob drug dealers are not  known for non-violence.

    While his decision to stash his weed in a daycare center may have been stupid, he did not commit any violence himself.  Hence the decision by the court.

    He knowingly put a bullseye on a daycare center filled with little kids. He had to know something very bad could happen. Its not the same as shooting the kids himself, but its almost the lowest form of child endangerment and should get more than 3 months. If kids had been slaughtered in a shootout, you might not feel the same way. although his decisions remain the same.

    He did a stupid thing, no doubt.  Were children truly endangered?  Maybe.  If children had been hurt, I would have blamed the people who hurt them, not this guy.  He did not paint a bullseye on the daycare center, but I'll hand it to you that that is flowery, articulate language designed to pull on heart strings in an attempt to win people to your side of an argument.  I'm sure that works in some arguments, but this is law, not church.

    You know why he kept this stuff in the daycare center and not in his own home? Because he knows its dangerous to keep it at home.
    BTW, endangerment (under the law) does not mean someone has to get hurt, but showing blatant disregard for other people's safety. I would say 10 pounds of weed and a lot of cash in an East Flatbush daycare center qualify.

    You may be right, but he was not charged with endangerment. And you have absolutely no clue why the weed was stashed there. That was plainly speculation, something else that wouldn't hold up in court. We can argue this all day, but it's clear that the judge gave the correct sentence for the charges he was found guilty of.

    The fact he wasn't charged and only got 3 months is not proof mistakes weren't made.
