UES Rape Suspect Says Sex Was Consensual (Though He Took Victim's Phone Away)

The man arrested for allegedly breaking into an Upper East Side apartment and raping a 27-year-old woman inside early Saturday morning claims it wasn't illegal. Specifically, Assistant District Attorney Samuel David said yesterday, "The defendant made a series of statements that he went through the window of the apartment and took the victim's phone, so she'd be unable to call the police, and had sex with the victim -- although he disturbingly claims it was consensual."

Jason Quinones, 21, was charged with rape and burglary after his DNA was reportedly linked to the crime scene at the East 90th Street apartment. His mother told the Post, "My son is innocent. My son is not a rapist . . . This is a big misunderstanding," while his grandmother told the Daily News, "He's a good kid; it surprises me," said Jason Quinones' grandmother, who declined to give her name. "I don't know what happened. Go ask his mother."

The building's super, who said the victim had only moved in recently, also spoke to the Daily News about the woman's first floor window—and the gate over it, "The gate was open. She always left the window open. Living on the ground floor - people can just climb right up." Other residents in the neighborhood expressed concern over their safety, with one saying she'd buy a big bat.

    too bad this kid isn't black, al sharpton would be proclaiming his innocence and virtue all over the telly

  • 21 years old and already an ex-con.....but he was a "good kid".  The really sad part is that it's not too hard to find jurors who will agree.

    If your apartment is located where 'good kids' can break in through a window [like ground floor!] MAKE SURE THE WINDOW GRATE IS LOCKED. Not a bad idea to close and lock the window itself when you go out and sleep. WAKE THE F UP! Especially women,for obvious reasons.

    Or, to take another approach: even if a window grate is not locked, or the window itself is not locked, do not enter a woman's apartment and rape her. WAKE THE F UP! Not committing rape is not really very difficult.

    Or, yeah, take your approach and put the responsibility on the victim.

    Everyone is responsible to a great extent for their own safety and well being. This means using COMMON-SENSE, like LOCKING YOUR DOORS, WINDOWS, GRATES, JOGGING IN THE PARK AT 3Am, ETC. especially if you're vulnerable and lack the ability [or will] to defend yourself. WE DON'T LIVE IN A UTOPIA.

  • You're confusing 'responsible' with 'accountable'.  Rape is not like bad weather at sea.  I'm not suggesting it's not worth talking about, but it really shouldn't be the first thing you talk about when trying to make sense of violence and cast fault.

    Things really just don't add up in this story. Good kids do not commit these kinds of crimes.

    I don't think that word means what you think in means.

  • "consensual" in thugese means "with sensuality". 
    i.e., "mommi, it was good, right? Tell them I was da best!"

    Doesn't every woman who gives "consent" have her male friend climb in through her window in the dead of night, then go running out into the street naked calling the police? I guess her front door wasn't working.

    He should get the chair and his lawyer should be strapped in along with him for the ride.

    Wow, the story hit the rape triumverate:

    - Grandma claiming alleged rapist was a "good kid" - check.
    - Accuser claiming "she wanted it" - check.
    - Peanut gallery claiming she was somehow at fault - check.

    Cue the balloons and streamers.
