Tyler Clementi's Roommate Moves For Dismissal In Light Of New Evidence

Dharun Ravi, the former roommate of Rutgers student Tyler Clementi, is requesting that charges of intimidation, invasion of privacy, and evidence tampering among others be dismissed based on new evidence submitted by his defense team that paints a more complicated picture of their relationship leading up to Clementi's September 22 suicide.

Fourteen minutes before Clementi posted a message on his Facebook account indicating that he was planning to jump off the George Washington Bridge, Ravi texted Clementi to apologize to his roommate for spying on him via a webcam he set up in the room. "I’ve known you were gay and I have no problem with it," Ravi wrote, according to the Star-Ledger, "I don’t want your freshman year to be ruined because of a petty misunderstanding, it’s adding to my guilt."

While it has been documented that Ravi poked fun at Clementi for being gay, instant messages show that Clementi made light of Ravi's Indian heritage: Clementi wrote Ravi was “sooo indian/first gen americanish” and that “his rents defs own a dunkin,” referring to a Dunkin' Donuts, the Times reports.

Previously it was believed that Ravi and his co-defendant, Molly Wei, broadcasted images of Clementi and a 25-year-old man worldwide on the Internet, but the defense now says that the video was only briefly seen by the two and a few other girls in the dorm room. Also included in the new evidence are details that Clementi came out to his family shortly before leaving for Rutgers and was "completely rejected" by his mother, while his father accepted his sexuality.

Clementi also told a friend he wasn't very upset when he initially found out that Ravi spied on him a first time with a web cam, writing in an instant message, "When I first read the tweet I defs felt violated/ But then/ When I remembered what actually happened ... / Idk (I don’t know) ... /Doesn’t seem soooo bad lol."

  • What gets me is that the State knew about this text when they presented the case to the grand jury to indict.... and hid it.  WTF?  Once again, the "win at all costs" - "truth and justice don't mean anything" mentality from a prosecutor.  They should be sued and prosecuted!

    Rutgers has brilliantly played the media into going along with their song and dance about having zero responsibility to respond to the issue the first time it happened. If I had a non-Indian, non-gay, non-moral kid who wanted to get a Comm or PR degree I'd defiantly keep them in mind.

    The invasion of privacy and the evidence tampering charges should stand. While it was probably a combination of factors that contributed to Tyker Clementi ending his life, his roommate still had no right to record him without TCs permission or to show thOse recordings to anyone, let alone upload them online. This kid should accept responsibility for his actions, not be shilling for a slap on the wrist.

    Yet Ravi is a coward and his act was an act of obvious cowardice. His own probable shame caused him to set out to purposely shame Clementi. What other outcome might he have expected? That Clementi would be amused? Proud?

    Of course Ravi, with his cowardice and his own deep phobias knew it would shame him. Yet he has now fully shamed himself and his family. And of course he doesn't want to go to jail where his own likely homoerotic fantasies might take shape in a brutal form.

    I suspect Ravi's "issues" will come out at some point in the trial. People will come forward with anecdotes to that end. Such cases are so often result of one's shame at feelings they do not understand and cannot face.

    There's not evidence that Ravi's vid caused Clementi to kill himself. . . except of course, the dead body of Mr. Clementi found under the GW Bridge per his FaceBook notice!

    I think that his mother's rejection or something that happened with the older man or some un-known depression issues would be much more of a factor in his suicide than some violation or privacy in college.  That kind of privacy violation is something that friends would do to each other.  Spying on some one doesn't necessarily mean that you hate them or wish them ill.  The media blew the situation out of proportion when it was widely reported that the gay encounter was broadcast all over the internet. The spying was wrong but it seems like Ravi admitted such to Tyler and maybe they were going to work out the issue.  There doesn't seem to be much evidence that Ravi bullied Tyler.  This is a truly sad situation but it seems like a bit a of a witch hunt to blame Ravi for Tyler's suicide.

    The court needs to focus on acts committed by Ravi and if they are found to be illegal he should be prosecuted for them.  In any event, Ravi is a despicable individual.

    Exactly -- had Clementi not jumped but had gone to the police about the incident Ravi would still be facing the illegal videotaping charges. So the bias thing is a bit dubious and will be difficult to prove; possibly weaking the entire case against Ravi who fully deserves to be prosecuted for his homophobic and despicable actions. Any DA, when told about such an incident, would have no choice but to prosecute as the law is very clear about such antics as Ravi's little joyride of taping -- and then. most importantly, watching and sharing and threatening to broadcast the incident. What straight man would watch gay pron, btw?

    Maybe he jumped because of the webcam, but the point is that this was not a bias crime.  The actions of the roommate were not driven by the fact that his roommate was gay.  Even if they were in a curious or inappropriately comedic sense, the defendant does not show hatred of gay people.  The charges should be dropped.

    Some one who calls what they did petty  "I don’t want your freshman year to be ruined because of a petty misunderstanding, it’s adding to my guilt." and is only concerned with his only feelings doesn't get it. Make an example of them both. It's time for GLTG people to start bashing back.

    You people are a trip; has it been conclusively determined why Clementi killed himself? No. IMO he did it for deeply personal reasons, maybe a failed relationship, issues with his mom,family. His being allegedly bullied for being gay is looking more and more bogus as the true facts trickle out, but it fits perfectly an agenda and many un-hesitantly ran with it. Now it's looking more likely the 2 'defendants' were railroaded.

    "fully understanding the situation"?  What does that mean?  Was he going to tell Clementi he was jealous Clementi found someone else?

    And how about the 25-year old man looking for freshmen meat?  Has he been ruled out as someone who drove Clementi over the bridge?  But probably there are no laws against that.

  • My working theory since this happened was it wasn't the webcamming that made Tyler jump; I was guessing his partner was deep in the closet and rejected Tyler when HE found out about the webcam.  I think that's why the partner is not being identified in the court docs.

    "it's adding to my guilt" makes it look more like an act of appeasing one's own conscience. Ravi does not say he is sorry to have made Clementi uncomfortable or for hurting his feelings or making him feel a pariah after Ravi and his friends enjoyed the video at his expense. Watching a gay encounter video is really really gay, btw.

  • Clementi apparently made jokes about Ravi's Indian heritage.  So there's not a lot of winners in this situation.
