Brooklyn Man Will Be Released From Prison Nearly 5 Years After Case Dismissed

Oswind David, who as we reported yesterday was jailed for almost five years despite the charges against him being dropped, will be released pending $75,000 bail. "It's what I have been praying for," David told reporters. The Brooklyn DA's office continues to proclaim David's guilt because "a jury would have convicted him of a lesser charge of second degree assault," in a rare legal maneuver called a "Minority Report."

While Bloomberg cuts salt and pepper from David's diet, the D.A. will continue to pour money into pursuing a case that hasn't existed for five years. Not to mention the money that will be spent defending the city from the inevitable civil suit for robbing this man of 4.5 years of his life. Ahhh, guv'ment. Naturally his original trial attorney, David Epstein, wouldn't talk to reporters, but his current lawyer has called the ordeal a "horrifying situation."     OK, 4.5 years in on a 18 year sentence for two counts first degree assault. So lets say they retry on the lesser counts and win. How much time would he get? I'm also curious on his prison behavior. If it was fairly clean, that should be taken into consideration. If it was up to me I'd let him slide as long as he promised not to sue. That is the problem here. If they just let him go he will sue and win. If they recharge and win. His case is a lot weaker. If they recharge and lose. They are SCREWED.

    Sounds like the DA cares more about their stats than justice.
