Judge Dismisses "Racist" Juror From Indefinite Jury Duty

4711juryduty.jpg This week, a Judge was none-too-happy with one potential juror who went out of her way to come off as racist and offensive as she possibly could. Juror 799 was disqualified from the death penalty trial of Bonanno crime boss Vincent "Vinny Gorgeous" Basciano, but Judge Nicholas Garaufis wasn't done with her, and sentenced her to indefinite jury duty. In the end, Garaufis relented on his penalty yesterday, while giving her a stern wagging on his judicial finger: "I hope this experience will be an education for you and the next time you're called for jury duty you'll give honest answers."

He explained his rationale for threatening the juror, an Asian woman in her 20s who said she works in the garment industry, with indefinite jury duty: "My ruling was not based in any way upon whether or not you held any racist views. It was apparent you did not tell the truth. You were the only juror who indicated that you had every form of bias imaginable. You were lying to the court in order to be excused." The woman tried to get out of jury duty by writing that she couldn't stand "African-Americans, Hispanics and Haitians", declaring that cops are all lazy and corrupt, and mentioning that she had a relative who was a member of the Chinese Ghost Shadows gang. She was seen reading a pamphlet entitled "A Guide to Continuing Your Education After Prison" while waiting in court yesterday.

She was freed to go, but Garaufis said he would dock her the $40-a-day juror pay, which she didn't argue with. Of course, it was inevitable his unusual punishment would not be upheld. For one, her obnoxious opinions were not inherently criminal: "She can't be punished for being a racist. You don't check the First Amendment at the courtroom door," said NYU Law Prof. Stephen Gillers. Two, as many commenters pointed out yesterday, Garaufis couldn't have kept her more than three days anyway. But most importantly, it wouldn't have lasted because Garaufis is a real softie, the kind of Judge who lends shirts to murder suspects.

    This stupid judge shows how far the near-bankrupt US government has gone. This woman has EVERY RIGHT to her opinions, and NO ONE can change it! For all those bleeding hearts, I think this woman expressed what many people feel, and I am surprised that the Asian community didn't come out in force with protest signs et al outside the courthouse. If Garaufis doesn't like her opinions, he should find another position, possibly as a defense attorney for the very people he's trying. I remember the line by the late Janis Joplin: "Freedom is just another word for nothing left to lose, nothin', no nothin' if it ain't free" .... Here's my best to the Asian community whose hard work and dedication knows no boundaries

    Part of the problem with jury duty is that citizens are treated so poorly. Manhattan still won't design a "call in the night before" program like almost every other municipality has.

    When in the courtroom, judges treat the jury in an arrogant manner. I was on a case where there were multiple charges on a person, but the judge wouldn't allow any of us to write them down. So we had to go back to the jury room, discuss a count, then reassemble and ask the judge what the other counts were. The majority of citizens don't understand "Murder in the first degree, manslaughter, etc" Can't there be a cheat sheet?

    I was on another jury one time, where we were given passes to come back the next day. The pass said "This person is on jury duty and should skip to the head of the entrance line". When I went to the head of the line, the security guard acted like a concentration camp guard telling me that there were no cuts to the head of the line and that I should have arrived earlier.

    No wonder nobody wants to go to jury duty.

  • But the police are lazy and corrupt, they only have 3 different communications devices in their patrol cars, yet you always see them parked next to each other talking, as though they didn't want people to hear them. Gee what could they be talking about? "Don't pull over the back thunderbird that is going through the county, that is the meth from the cartel". "Okay I will pass the word along".

    jury duty is your civic duty as an American citizen. one of a few requirements of our nation. if this is too inconvenient for you, get the fuck out. she is probably one of those stupid bitches on her phone walking blindly through the garment district as if she is saving lives. either that or one of the sweatshop workers sewing pants for theory.

  • are you trolling? Jury duty is a overt form of slavery, the expression by which our masters show us who is in control. A slave is under no obligation to leave his home, to the contrary, it is the obligation of the masters to stop oppressing the slaves, and if anybody should leave, it's them.

    I'm not sure why this myth of jury duty being some profound service persists. Its history, at least recently, has been to allow white southerners to kill negroes. Alternately, it sometimes allows a rich celebrity negroe to kill their wife and a waiter. In LA, our black gowned overlords enjoy reading a quote from the well known hypocrite and racist, Thomas Jefferson, to the effect that Jury service is a sacred duty. I wonder what master Tom might have thought of negroes on a jury judging him for coercive sex with Sally Hemmings.

    Jury duty is corvee labor. If you want people to do Jury Duty pay them, better. Few people can't find a more productive use of their time than being shuffled from courtroom to courtroom by arrogant, ignorant baliffs or being insulted by arrogant, stupid judges. Its gotten so bad in LA they had to stop exempting Judges, city workers and friends of the mayor-- Imagine their chagrin. Government workers are paid for jury duty as are some, although fewer and fewer, private sector workers.

    Since you feel so strongly you can volunteer for jury duty. Judging from your reasoned appraisal of the woman in question, I'm sure any attorney would want you on a jury panel.

    Actually in most jurisdictions you cannot volunteer for jury duty. NY is an exception in this regard.

    Saying something like that in a country where most people live paycheck to paycheck because they can't be bothered to educate themselves and then get out and vote is.. well it's the right thing to say.

    It's just sad that most people won't pay any attention.

    as he should be. Too many people (and this would-be juror is a fine example) take advantage of the benifits of u.s. citizenship while shirking the responsibilities. She'd probably be the first to bitch if we began trying and convicting suspects in the basement of obsure gov't buildings by anonymous political cronies and sycophants
