Texting Teen Charged With Negligent Homicide

A Brooklyn teen has been charged with negligent homicide after hitting a delivery man while she was allegedly texting behind the wheel. Nechama Rothberger hit scooter-riding Tian Sheng Lin as she made a left turn on Avenue P near East 17th Street in Brooklyn, which left Lin with severe head trauma. Lin was declared brain dead, and later died from his injuries.

Rothberger initially was charged with a misdemeanor of reckless driving and using a mobile phone while driving; she told cops she didn't see Lin, and police found a half-written outgoing text message on her phone at the scene. Rothberger's lawyer previously said that she "didn't hit him intentionally. It was merely an accident." Rothberger is free on $5,000 bail, and Lin's wife says she wants "justice for my husband."

  • How can they prove she had a half-written text message? I have a bunch, it's called a "drafts" folder. Sometimes I'm drunk texting and not drunk enough to hit send or just decide to blow it off and type it out later... does that mean if I hit someone the cops will nail me for texting and driving?

    I'm not saying she's not an idiot, I'm just wondering how rock solid the cops' case really is.

    How long until our cars are equipped with cell phone kill switches?

    no1 is entitled to a lcense. the privilige to drive comes from hard work and practice. drivers should take a mandatory test every few years. this grl is a retard

    If you don’t have a phone on you after an accident, it is going to be hard for anyone to prove you were texting while driving.

    If you don't have a phone on you, then you probably weren't using one, no?

  • You can still get the phone records to determine when the phone was used last...so whether you throw it out the window or whatever...the records will be all the proof they need.plus most phones have a GPS so they could also locate the phone....there is nothing private about a cell phone...so use with caution...

    All the more reason to remember to either clear your phone’s memory, or get rid if it altogether after your involved in an accident. You may not remember that you checked your phone at the last traffic light.

    Too much practice at the gun range. Must have given you lead poisoning. The police and DA don't get evidence from the phone. They get it from the phone company. Just like email, records of all calls and messages remain on the company servers whether or not you delete them on your phone.

    The cops in Brooklyn must be really good because the story seems to be that she was given a ticket for using a phone at the scene of the accident; and that a partially written text was found on her phone.
    You don’t really think the cops traced her phone activity at the scene of the accident do you?

    I suppose you are aware that NYPD can ticket you for just about anything, even on spurious grounds. We see such stories on a regular basis here. On the other hand, if there's so much as suspicion of cell use, such as a witness reporting seeing one in your possession, I'm sure prosecutors would quickly subpoena the phone records, so throwing it away or deleting everything won't do you any good.

    Text messages don't retrieve themselves. And most phones don't read your text messages out loud to you. She was probably distracted by having a sms conversation.

    I agree the girl isn’t attractive, and she dared to operate a motor vehicle (a Gothamist sin), but can someone tell me how in the hell does anyone know she was texting while driving? I don’t see anything that supports that. Nor do I see anyone say “allegedly texting.”
    If she was texting AFTER the accident, wouldn’t it be logical she may have had a partial text in her phone when the cops arrived? How does that prove she was texting while driving?
