"It's Just An Accident" When SUV Hits Mom With Stroller

2010_11_sv.jpg Yesterday afternoon, a 73-year-old man driving a Lexus SUV struck a woman who was pushing her 6-month-old son in a stroller on Broadway near 37th Street in Astoria, Queens. The Daily News reports that the vehicle "shot down the sidewalk like a pinball... It blazed a trail of destruction for about half a block before it mowed the woman down from behind - sending her son and the stroller hurtling through the air." Amazingly, the boy did not appear to be hurt when he landed. The mother, who was rescued from beneath the car, is expected to survive. The driver allegedly told the cops his brakes failed and wasn't charged or given a summons; a police source said, "It's just an accident."

    I'm sure he just got right back in his SUV and drove away, confident that he wouldn't have another "break failure".

    So those who are saying he should be arrested, are you implying he did it on purpose? That there was some premeditation on his part to warrant a crime? An arrest? Was the driver under the influence? Perhaps there needs to be a rectification for elderly drivers, but that's another topic.

    If you're walking along and bump in to a child, they then fall and get a scrape. Is that a crime? Granted, it's not the same, but it's amounts to the same amount of intent.

    Regardless of the NYPD's reaction, the person hit can still sue civilly and the person who hit them is liable for medical expenses (most likely paid for by the insurance company).

    Well said. It is an accident when someone makes a mistake and negligently causes damages to others. In the case of accidents, the negligent party can (and will) be sued for damages by the injured party. Most auto accidents (ex. rear ender, parking lot, etc) result from negligence and are not a criminal matter. While most accidents caused by negligence are not serious, some cause serious injury or even death. Nevertheless, they are simply accidents and are not a criminal matter.

    The police get involved in automobile cases when the driver goes beyond negligence and behaves recklessly or intentionally. Examples are: DUI, drugs use, racing, road rage, etc.

    In this case "brake failure" was likely the result of confusion followed by panic. While sad, there is no reason for the police to get involved.

    Solution: Confusion and panic must be legally prohibited!

    Right, the NYPD created this whole "car culture", and that's why this is the only city in the country where the driver in an incident like this isn't immediately arrested.

    Hmm, looks like a Toyota was involved.

    Normally, I'd blame the elderly driver, but it would seem that Toyota still has some work to do in getting their unintended acceleration issues under control.

    From what I remember most of those accidents were proven to be driver error and not a defect of the car.

    Its the responsibility of the driver to take care of their car.

    Isn't there this little item called an emergency brake? For, you know, emergencies. And the reason he didn't bother to use it is . . . ?

    the "emgergency" brake is really only a parking brake, and depending on the speed of the car, won't even slow it down at all.

    ...he was probably too busy wondering why his brakes weren't working as he continued to slam on his gas pedal.

    That's all my speculation of course, but you know brakes in a luxury automobile that were working perfectly fine do not catastrophically fail out of the blue.
