Yorkie Can Stay In New York

yorkicharlie1110.jpg A woman has been fighting for the right to keep her teacup Yorkshire terrier with her at her Queens condo, after the Village View Condominium board tried to evict the 4-pound-pup (and spent $100K doing so!). Last year the Queens Supreme Court ruled the board had the right to ban pets, but the Appellate Division rejected their ruling this week, according to the Daily News.

The Appellate Court argued that a ban must be written into the bylaws and approved by 80% of the condo owners—the Middle Village board did get the approval, but neglected to write it into the bylaws. While they do have a no-nuisance provision which bans pets that disturb other residents (this can sometimes lead to an owner turning to the controversial debarking), the teacup pup Charlie (pictured) has never had any complaints filed against him.

Yesterday Charlie's owner—52-year-old Donata Forman—said after the 2009 ruling she decided, "I'm going all the way with [the case]. I need him because he's a part of the family." However, she also said, “He’s not one of those yapping little dogs. I would get rid of him if he was." Ah, just like a real family.

    I'm glad she won, it's not like she owns a Huskie, or a slobbering St. Bernard. I think it's retarded that property owners blanket ban pets - when I moved in June, I experienced one who wouldn't budge on my cat. His loss, the place is still vacant.

    It was depressing to hear her say that none of the other residents in the building will talk to her any more, I'm assuming because of the cost being passed to them. Their anger is misdirected, they should aim it at the incompetent gestapo co-op board.

    oh, i see, gothamist. so it's 'bad' to own 'degenerate' 'mill-bred' teacup yorkies, unless the owner is being forced to give it up, in which case the owner is a-ok and instead it's the landlord that's evil.

    They should definitely consider voting out their board after this fiasco. I heard that each owner will be assessed $900 to cover the legal costs of trying to kick out this(harmless) dog.
