DOE Dismisses 5-Year-Old's Rape Allegations Against Classmates

090810sexshock.jpg You may recall yesterday's horrible story about a 5-year-old boy who claims four of his older classmates sodomized him in a school bathroom in June. Or you may have succesfully blocked it out as a method of Back to School self-preservation. If so, you're not alone: The Department of Education also seems eager to make the incident go away. A DOE spokesperson tells the Daily News that after an investigation, "the allegations could not be substantiated." But that's not what an NYPD detective told the boy's mother.

Yenny Valero, the unidentified boy's mom, tells the News, "The police investigation says the exact opposite. The detectives told me it was true. One of the kids confirmed what my son says. He gave details about what happened to my boy." Her son claims four boys, all 6 or 7 years old, accosted him in the bathroom of the Queens school, held him down, removed his pants and inserted at least one finger into his anus. Naturally, Valero's suing the city; her lawsuit claims that her son, who wears ankle braces because of balance issues, suffered physical injuries and posttraumatic stress disorder.

    If he doesn't get justice, I hope the victim gets long term counseling. My heart goes out to him. Being traumatized at such a young age...

    Couldn't be substantiated? Gee, that sounds familiar. It's just your kid complaining, and all the kids who abused him claim it's not true, so we'll make it easy for ourselves and believe the attackers! And if you complain more, we'll make your kid's life even more of a living hell than it already is.

    And believe me, they will - I really hope this child doesn't still go to that school, because the administrators may well sic the other kids on him to get him to shut up. It happened to me.

    Im sorry to hear..Ive seen this shit go down and ive seen the bs outcomes...like nothing happend..i hope something gets done because this wont be the last time..

    Damn I don't know exactly what happened to you but it sounds like it still hurts to this day. When I read your first comment about this subject the other day it really touched me. I can't imagine what its like but somehow feel your pain.

    I'm glad you've spoken out so other people realize that these are very traumatizing events and not just some childhood game gone wrong. Something like this can ruin a person's life forever, although thankfully you sound well adjusted but others may not be as strong as you.

    The DOE should take these cases very serious and recognize that by sweeping something like this under the rug they are ensuring that it will happen again.
