NYPD: That's A Drunk, Not A Cop, In Rape-Threat Video

082010cop.jpg The NYPD has gotten back to us on that video supposedly showing an undercover NYPD detective threatening a videographer with prison rape after a raid at the artsy DIY party club Surreal Estate in Bushwick. Cheryl Crispin at the Office of the Deputy Commissioner tells us, "The individual making the statements that you are referring to is not an NYPD officer." So who was he?

According to the NYPD, just some random drunk slob. We asked Crispin if he was associated with any other law enforcement agency, and she told us, "From what I heard from other officers at the raid, he was kicked out of that party and was issued some kind of traffic summons. He was just drunk and acting like a cop." Indeed, it was a convincing performance, what with all the rape threats and the stupid insults.

Since he's not NYPD, if we had to guess we'd go with meathead cop from Long Island who happened to be driving by the party after getting a ticket. At the very end of the video, around the 6:46 mark, one uniformed officer (jokingly?) says he's "one of our undercover officers." And the tie-dye guy seems to be asking the cop for a favor regarding the summons in his hand. He can be heard saying, "He gave me another ticket." The uniformed officer replies, "For seatbelt? I'll talk to him." And before walking away, Mr. Tie-Dye says something that sounds like, "If this is gonna go to court your going to come and save me, right?" Or something. It definitely sounds like buddy-buddy cop talk.

And Vladimir Teichberg, who shot the video for Glass Bead Collective, isn't convinced either. He tells us, "We have the following evidence that he is indeed a cop (or at least someone who was working on that raid with the NYPD):

  1. He was at the door to the space being raided together with the officer in uniform. We have the officer in uniform introducing him as one of our undercover officers as they are flirting with girls leaving the event.
  2. The tie-die shirt guy says he is a detective and threatens to arrest me, take me downtown etc in front of the uniformed officer at the door to Surreal Estate
  3. The tickets in question, are multiple tickets are look like ticket reciepts - i.e. the part of the ticket police keep for their records, and there are multiple ones.
  4. Both the uniformed cop and the tie die guy leave together when the commanding officer comes out of the building.

Crispin, the NYPD spokesperson, tells us there were 9 arrests at the raid and the charges consist of: Assault, Obstructing Governmental Administration, Unlicensed Bottle Club, Selling Alcohol without a License, Unlicensed Warehouse Liquor Storage, and Disorderly Conduct.

    If the perp gets put in jail for a while it may well be a cellmate that`s going to give it to him, however there is a toilet plunger sold everywhere called the "Signature Amadou Diallo Model" to break in the perp first, kind of like a warm up routine.

    Do you have any clue what you're talking about? It was Abner Louima--not Amadou Diallo--who was brutally sodomized with the handle of a bathroom plunger by NYC police officers after being arrested outside a Brooklyn nightclub. Louima later sued the city and received a settlement of $8.75 million.



    Amadou Diallo was the unarmed innocent victim in the Bronx who was shot and killed by 4 plainclothes cops who mistakenly believed him to be a serial rapist. The cops fired a total of 41 shots, 19 of which struck Diallo. Although the undercover cops were amazingly acquitted of all charges by a jury in Albany (yes, Albany), a civil suit against NYC and the NYPD later awarded a $3 million settlement to Diallo's mother and stepfather.

    Usually, police will only charge someone with impersonating a police officer only if it occurs during a commission of another crime. For example, if this guy proceeded to grab somebody, put handcuffs on him/her, and took property, then the police would most likely charge him with robbery and impersonating a police officer. On the other hand, if some guy is just going around telling people he is a cop (as this guy seemed to do), chances are he would not be arrested.

    I'm not going to bother to watch the video again, but did he even actually say that he was a cop, or did people just assume it?



    Anyway, you're essentially right. It's actually not illegal to simply say that you're a cop. It only becomes a crime of you take some action, or coerce someone else to do something, based on that pretense.

    Yeah they should raid such a place. You know just as well as me that if the police did nothing about this place and at some point there was a fire or some other serious incident, the police would be lambasted by the people on this board.

    Thing is...impersonating an officer is a serious crime. If he was doing this in full view of uniformed officers and they didn't arrest him as well, I have serious issue with the conduct of the officers present.

    Cause they're dealing with all that other shit, if you are using discretion as they should, this guy wasn't a threat, or in a fake uniform, or with a fake badge, or doing anything to these people besides talking drunken shit. They probably weren't even paying attention to this dude.

    It has nothing to do with anyone being a tough guy - they were working, and the guy was a drunk idiot who wasn't causing any harm to anyone and they probably weren't even listening to what he was saying, shut the fuck up. A lot of coprs are assholes but they're just doing their job, and YES I find tha ttrue even if they weren't listening to this drunk guy blabber on to people while they made videos of him. They probably thought it was for hipster acting class.

  • It might be prudent to replace "cop" with "officer" so's to sound more official. An officer who violates the law is more serious than some cop. Great job, John.

    Anyhoo, it strikes me that this would be a convenient way to disown the behavior of any undercover cop. "It wasn't a cop, it was just some nut pretending to be a cop." Can't be bothered to watch the video and I don't really care, but sounds like "plausible deniability" to me.

    I'm thinking that Vladimir is a secretly embedded russian spy and the undercover cop in question is one also - but wait, he wwent rogue and now works on his own terms because "they took everything from him he ever cared about". I can really see this story ending with a fight to the death ontop of the Statue of Liberty or maybe while parachuting with snowboards on.
