I'm a lawyer, though not a criminal lawyer, so don't take this as a full answer, but from my understanding, criminal charges are more than just whether the guy did it. The charge is that a person violated a certain law. To prove the violation, the state must prove more than that the person committed a certain act, they also must prove that the person had a certain criminal intent. There are a whole range of possible criminal intents that could be attached to fatally beating someone, and it would greatly change the possible sentence, depending on which law the person was convicted of. First degree murder is a lot different from manslaughter. That's why people who are obviously "guilty" of something, still usually plead "not guilty" at least initially.
