LI Man With HIV Gets 14 Years For Unprotected Sex, Abuse

Yesterday, a convicted sex offender who admitted to having unprotected sex with boys and men ages 16 to 20—while not telling them he had HIV—was sentenced to 14 years in prison. Oceanside resident Robert Musmacker, who knew he was HIV positive since 2005, had pleaded guilty to 25 charges, including reckless endangerment, criminal sex acts and endangering the welfare of a child, and was also sentenced to 15 years of post-release supervision.

Prosecutors claimed that Musmacker, 37, used gifts of cell phones, alcohol and marijuana to lure his victims. One spoke at the sentencing yesterday: Newsday reports, "The man... said he found out from news reports after Musmacker's December 2008 arrest on sex abuse charges that the former independent newspaper delivery depot employee was HIV positive." The victim, who was 16 when he had sex with Musmacker, said, "He messed me up... I trusted him... Why would he do that to us?" and added, "I think he's going to strike again."

Musmacker had tried to withdraw his plea, claiming the prosecutor "coerced" him, but the judge didn't allow it. Newsday also noted that Musmacker's mother wept at the sentencing and shouted at his victim; she told reporters, "The moocher lied."

14 years? That's it? For knowingly spreading HIV and more importantly for abusing underage boys, all he gets is 14 years? If he survives the 14 years, which there'sa good chance of that being that he will now get the best medical care available in jail, we'll be reading about him again in the future. By the time he gets out he'll only be 51, still able to inflict a lot of damage. Our justice sysem sucks!

He should get more than 14 years for exposing minors to HIV. However, consenting adults should always be aware and use condoms.

This sounds a bit drastic.

There are plenty of people in NYC who are HIV +. There are also plenty of them who insist on the use of a condom. I don't agree with this guy knowingly infecting people.

However, it take two to tango. Just as much the partner's fault. Sorry.

I agree. I'm not excusing it. But seriously, it's your responsibility to protect yourself. If someone tells you their negative, how do you know that's true? Most HIV infections are spread by people unaware that their HIV +. Those who aren't undergoing treatment are far more contagious that those who adhere to treatment.

The pig's mom sounds like the mom of that cop who killed the jaywalker ("My son deserves to let loose [including driving drunk]"). Calling the victim a moocher doesn't excuse the fact he screwed boys.
