Mom Sues Starbucks Over Infant-Scalding Tea

070310starbucks.jpg Same as it ever was. A Brooklyn mom is suing Starbucks, claiming "improperly served" hot tea caused her to drop the beverage onto her 5-month-old son, causing him serious injuries.

Last October 9th, Villona Maryash went to a Bensonhurst Starbucks with her son and ordered a hot tea. The tea was served without a protective sleeve, and Maryash says it was so hot that she dropped it. Maryash's lawyer says the tea should have been served not just with an insulating sleeve, but on a tray as well. The insulating sleeves are printed with a warning that the beverage is "very hot," but some cups have the warning printed right on the cup.

In May, a woman sued an Upper East Side Starbucks after being served tea that was "unreasonably hot." She allegedly suffered "great physical pain and mental anguish" because of Starbucks' negligence.

    I'd take this a step further. It should have also been served inside a heat proof plexiglass box with an electronic thermometer that would light up to tell the idiot that it had cooled down to a safe temperature.

    Are they? Or are the idiots who keep selling coffee hot enough to burn and in manners in which clumsy people can burn themselves, even though they keep reading about places being successfully sued for it?

  • Yeah, they should tell their baristas to automatically put a sleeve on all of their hot beverages - after all, this isn't the first hot liquid lawsuit that's been filed.

    what kinda dumbass is gonna hold something so unsafe near a baby!!! it sounds as if she never considered the posibility that she had to be carefull what a fucken stupid person im sure she has to live with her stupidity from now on.

    I have a few assumptions about this.

    #1, as stated before; NO ONE could pick up a cup, move the cup over their infant child, and then realize it's hot and drop it.

    #2, this says it happened back in October. Why is she deciding to do something about it now, instead of WHEN it happened?

    Hopefully the judge will look at this and throw it out, reminding the lady how careless she is and how stupid she is for bringing yet another tort lawsuit to the legal system.

    #3, that ambulance chasing attorney needs to have his bar card pulled for thinking that Starbucks should serve drinks on trays.

    How long does it take to realize, hey, that cup has no sleeve, and it could be hot. I can guarantee that it was no where near hot enough to drop it.

    Someone should find out who the lady is and see how many other claims she's made in hopes of getting rich quick.

    A suit like this is typically filed only after months of negotiation. She almost certainly did "do something" months ago, this is where it has now progressed.

    Also, presumably the suit includes medical expenses. You can't sue for real damages before you know what they are -- meaning, until the bills have arrived.

    whenever i go into a starbucks i watch out for the stupid mothers with children type.one time a mom went to the counter where the sugar and milk is,with her chid who was smaller than the counter.the mom went to spice up whatever she bought,i was right behind her.sure enough,there goes her drink,right at her kid.i grabbed the kid and pulled him out of the way.she thanked me for pulling him to safety.i don't understand how these people survive even menial tasks,how do they cook at home without burning themselves or the house down?and if a judge offers her an award,the judge should be slapped along with the careless mother.

  • In New York City, it's called ACS [Administration for Children's Services] not "CPS" and yes, under certain circumstances, they could.

    Why don't I ever get selected for jury duty for a case like this? I'd vote to:

    1. Make her reimburse Starbucks for their legal costs

    2. Apologize to the citizens of NYC for wasting our court time

    3. Have her arrested and charged with child abuse for scalding her kid

    Once or two in a rush, I grabbed the hot coffee without realizing it had no sleeve. Yes, it stung but I held for that extra second to put it back on the counter. I didn't just dropped it and have it spilled on people around me. Seroiously, she couldn't hold the cup a second longer instead of dropping it on her baby? If only this baby could sue this mother.
