Subway Self-Defense Stabber Freed

Brenddy Garcia, who fatally stabbed two men on a 2 train in March, was freed from Rikers Island yesterday. On Friday, a grand jury believed that he acted in self-defense and did not indict him for murder. The Post caught the 19-year-old "relish[ing] his first seconds outside of prison, beaming a big smile and deeply breathing in the fresh air," and Garcia sarcastically said to the reporter, "I’m a monster, right?"

Garcia was referring to how he was initially painted as the aggressor in the early morning confrontation (and the machete picture probably didn't help either). Witnesses confirmed that Garcia was being attacked by a group of people on the subway when he used a folding knife with a four-inch blade to stab Ricardo Williams and Darnell Morel. Garcia's lawyer said, "He got jumped and had no other choice than to do what he did."

The Post spied what looked like a party at his family's home in Brooklyn. While Garcia's family did not comment, one person heading in said, "Justice has been served." And speaking of subway violence, a 20-year-old man was stabbed, possibly by a group of men, in the neck, arm and stomach last night at 9 p.m. on a J train.

  • O.k. You got me there. Those are scary Pix. I dont like Gangs. But I never said I did. I just thought it was o.k. to defend yourself and have the Law/People/State Of New York say you were in the right to fight for your life. And that is what Eye Witnesses said they saw. A man being violently and viciously attacked by RuthLess/HeartLess savages for no reason at all. Just because they thought it was funny or cool. And he fought for his life, but some people here on this Blog are actually saying he was wrong. He was wrong for defending himself. QSTN! Somebody answer this, "WHat was he suppose to do?".....??????????

All you cowards need to show yourself. Lets see what you look like, and then critisize somebody else's look. Stop being cowards! I said it before, I dont like the Photo myself. But what he did was tell these so called gangster's that some New Yorkers will defend themselves and win in Court. So dont fuck wit us! I think thats a good thing. We need more Men with spines like this in N.Y.C. and less cowards judging people based on thier looks and hiding they're own faces. Cowards!

    Some of the previous articles pointed out that he had been assaulted twice, one time in 2007 that left him in a coma with 275 stiches. So, I think he has a reason to be carrying a 4" folding knife (NOT a switchblade)

    Let's not make this guy a hero. From the photo of him that Gothamist has previously posted he is clearly wearing Dominicans Don't Play paraphernalia. Chances have it that his 2006 assault (that apparently led him to act in this way) had something to do with his gang affiliation.

    Just to clear things up:

    White people in Texas carrying concealed weapons are patriots and defending the Constitution.

    Brown people carrying a knives are criminals.

    Switch blades, butterfly knifes, and collapsible batons are all illegal.

    To be fair I believe any knife with a blade longer than 3 inches is illegal to carry. Also, you can't carry a concealed knife - meaning you can't have a knife in your pocket, it has to be prominently visible, for example clipped to your belt. I think Garcia will still get charged with something minor. But I am no law expert.

    Exactly the opposite, in fact. Under NYC Administrative Code, it's illegal to carry any type of knife (no matter how long the blade or whether the blade is folded or not) in open view or worn outside the clothing. Even a leatherman tool with a folding blade can not legally be carried in a belt holder in NYC; it has to be out of site.

    You're right about the 4-inch restriction.

    Oops, actually not quite right, should've looked back at exactly what you wrote before saying that -- three inches is not correct.

    A folding knife with a blade under four inches is legal. Any kind of dagger, stiletto, or similar knife can not legally be carried in NYC regardless of the blade length. Basically, if it looks like a weapon you can't carry it.

    Do you perhaps have a link that specifically lists these rules in clear language? Because I really need to know. I recently bought a folding knife that was a notch under 4 inches, and the store owner told me it was illegal to carry. Also why do they sell knives with belt clips in NYC if you can't clip them to your belt legally. This sh1t sucks. Soon they will prohibit men carrying their penises.
