Elderly Woman Hit By Sidewalk-Jumping Livery Cab

A livery cab hit an elderly woman on 98th and Broadway yesterday after it apparently swerved onto the sidewalk, avoiding a collision with a left turning taxi. The impact from the taxi threw her against the wall, and she was taken to St. Luke's Hospital for possible head injuries. There appeared to be no damage to the car, and as of now no charges have been filed, which seems par for the course. [Via StreetsBlog]

    Maybe the driver should have been charged in this case (it's hard to tell given the shitty description), but as for the "par for the course" article you linked, it was from almost a year ago and clearly the cab driver was not at fault, so why would he have been charged?

    I promise to do that as soon as you have the decency and honor to pay a visit to Nancy Gruskin, the widow of Stuart Gruskin, who was killed by a cyclist riding the wrong direction, and apologize to widow Gruskin for all the vehicular laws that you and you fellow cycling zealots violate on an constant basis.

    The woman last night was accidentally hit by a driver swerving to avoid an accident on the roadway. The cyclist who killed poor Stuart Gruskin was willfully and deliberately violating the law, like so many cyclist do.

    In a ten-minute walk today, I encountered 5 cyclists on the sidewalk, and God knows how many going opposite the flow of traffic - the same behavior that killed Stuart Gruskin. What are you, Drewo, doing about that epidemic?

    Would you like Mrs. Gruskin's contact information in order that you can pay your respects?

    Trust "thefacts" to dig up the one fatal pedestrian accident caused by a bicycle in recent history, the better to further his anti-bike agenda. Only a complete lunatic/asswipe/zealot would suddenly bring bicycles into the discussion where previously there was no mention.

    The link may not have been timely, but it is "par for the course" that a driver is not charged. Please show me a recent incident like this where the driver was charged. The only time there may be charges is if the driver is found to be drunk or impaired (if breathalyzer tests are administered right away - which is not always the case), or driving without proper license, permit or insurance, or if the driver is speeding or committing some kind of moving violation.

    In this kind of case, the incident is dismissed as an "accident", where, with a just a little bit of investigating by the NYPD, it may be determined to be gross negligence or assault with a vehicle, or some kind of moving violation. But the NYPD is lazy, and the NYPD rank-and-file see the world through their windshield - not from the perspective of a pedestrian.

    Either way you have an old lady in a hospital and a driver who is dusted off and excused. This should not be acceptable in a first-world, civilized society.
