The feds approached one of the indicted men, soldier Onofrio "Noel" Modica, 46, last week before the bust (as he was walking to his physical therapist) and tried to get him to turn on his compatriots. But he refused and was arrested on Tuesday. Modica's lawyer claims that the feds are getting back at him for not cooperating.
The feds allege that Modica was involved in a double-murder in 1987, owned a motorcycle used in another mob slaying on Staten Island, and was accused of conspiracy to tamper with the jury in John Gotti's trial in 1992. Modica was the only one arrested who put in an application for bail, which was set at $2 million. Outside Manhattan federal court today, his lawyer Matthew Mari denied all charges: "This is preposterous. Modica is not in the mob. He knows a lot people in the mob." And that $12,000 in cash at his house? It was for his son's confirmation!
