Malkovich Mad Over Madoff Investment

2010_03_malko.jpg Actor John Malkovich is Malkovich Malkovich MALKOVICH over his investment with Ponzi king Bernard Madoff. His lawyers are trying to get his entire $2.2 million investment back—because the trustee dissolving Madoff's assets will only give him $670,000—and filed a petition in federal bankruptcy court.

Reuters reports, "Like many other Madoff investors, the Malkovich trust argued that it deserves the balance reflected on its November 30, 2008 account statement from Bernard L. Madoff Investment Securities LLC, the final statement prior to Madoff's arrest 11 days later." His lawyers claim, "A customer generally expects to receive what he believes is in his account at the time the stockbroker ceases business." Um, what if the stockbroker is a total liar? His lawyers have an answer for that:

The trustee’s determination assumes that Bernard Madoff never earned funds and therefore all gains reported to customers were ‘fictitious.' This assumption is contrary to fact. There is significant evidence that, at some time, BMIS was at least in part a legitimate business and therefore all or a portion of the gains were not fictitious.
Pfft! Madoff's trustee has reportedly only located $1 billion in assets—it's estimated the fake profits are along the lines of $60+billion. Last month, a judge ruled that Madoff's victims shouldn't count on the fake profits stated—and it was confirmed that Madoff did receive a beatdown in prison last year.

    You were robbed. The guy's in jail. Most of the money is gone and you're lucky to get anything back. Stop crying and move on.

    How hard is it for people to understand that when you invest in bogus BS, your money no longer exists? If I invest in a stock and it goes down, do I deserve to get the original amount back?



    All these victims can/should be doing is pressing for financial reform and a more competent SEC.
