Woman Sues Cop For Allegedly Causing Miscarriage

2009_09_handcuffs.jpg A Queens woman is suing a cop for $5 million, claiming he caused her to fall on her stomach while she was six months pregnant and eventually miscarry. Police were called to 21-year-old Felicia Dantzler's house after her fiancé reported a fight with her neighbors on March 21st. Dantzler told the Post, "He swept his foot under my feet and I fell on my stomach and face." Five days later, she delivered a stillborn daughter.

The fight allegedly started after a break-in in her neighbor's apartment. Dantzler said the neighbor started pounding on her door, blaming her for the burglary. And though she admits she took a swing at her neighbor and accidentally hit the police officer, she claims the cop was unnecessarily forceful with her. After kicking her to the ground, he reportedly cuffed her and kept her on her stomach for ten minutes. Marilyn Fernandez attempted to tell the cop Dantzler was pregnant. "He was not listening," Dantzler's friend told the Daily News. "He told her to shut up and be quiet."

Four days later Dantzler went to a previously scheduled checkup with her doctor, who told her the unborn child had no vital signs or heartbeat. Lawyer Pamela Roth says Dantzler is waiting for autopsy results, but said, "My client stated that it was a problem-free, normal pregnancy before the incident." Police claim that both the officer and Dantzler fell to the ground after the punch, and Dantzler was cuffed, taken to the precinct and issued a disorderly-conduct summons. Dantzler's suit claims she was "falsely" arrested.

    cop grabs infant out of sling, claims suspect made furtive movements, cherrios passed to other baby was suspected as drug deal, baby handcuffed with knee on neck for 20 minutes while id check for warrants was run.

    doesnt sound too unusual...

    We're not talking about a confession she made to police...she concedes in her own lawsuit that she hit the cop.

    Ok, so hitting a cop is really, really stupid and this woman does not exactly sound like the epitome of classy.

    However, there seems to be an ongoing and widespread problem of the NYPD using too much force and knocking someone to the ground (if her account is true) seems to be a bit much. Also, if the person you've knocked to the ground says repeatedly that she's pregnant then maybe a different way of subduing that person would be more prudent.

    Whatever this lady's problem is, she doesn't deserve the tragedy of carrying a child to 6 months only to have it die right after she was involved in this altercation.

    We do live in an overly litigious society, but if this really happened then it seems like a pretty solid reason to sue.

    OH CRAP, one more FUN FACT:

    in 1997, a Giuliani judge convicted me of "summary contempt" in court and gave me 30 days in jail illegally. My own lawyer refused to help (b/c there is no accountability in the legal profession).

    I did 17 days in Rikers but was released on Time Served by another Giuliani judge who said I was guilty.

    When my appeal went to judges ABOVE Giuliani's head, ALL FIVE UNANIMOUSLY SAID MY "CONVICTION" WAS CLEARLY ILLEGAL and reversed it.

    Was I able to SUE for 17 days in jail falsely held?

    NOPE.

    (Thanks to legal loopholes.)

    TELL ME AGAIN HOW EASY IT IS TO SUE THE CITY.

    STOP believing media lies and govt lies.

    PLEASE??

    Almost none of these cases go to a jury b/c the City always SETTLES at the last second because the govt INDEED broke the law.

    They then LIE about it, claiming "it's cheaper to taxpayers to settle" and not one reporter asks "but then why did you settle YEARS into litigation instead of BEFORE you paid for the army of lawyers of the Corporation Counsel to try and stop these lawsuits?"

    If it was about saving money, they wouldn't wait til a jury is being selected to settle, duh!

    They'd settle years earlier.

    SOMEDAY you will all learn to stop trusting politicians and their cronies.
