Fight Over "Prison-Based Gerrymandering" in Census

033010prison.jpg Politicians and convicts alike are arguing with the Census Bureau over where prisoners are counted. Currently, prisoners are counted as residents of the areas where they are being held, not from their hometowns. The last Census information counted 43,740 inmates from the city as residents of towns in upstate New York, meaning those areas could get more legislative districts based on a false population count. Former Attica inmate Ramon Velasquez told the Daily News, "It's not fair because we don't use their services. We're being counted just for a political purpose."

Though it's too late to change it for this census, Senator Eric Schneiderman has introduced a bill with Assemblyman Hakeem Jeffries that would change the system for the state. Schneiderman said, "The poor communities the prisoners come from ... are punished every 10 years." Upstate politicians are opposing the bill, saying prisoners use public services like water and sewers, and that there is no guarantee they will return to their hometowns when released. "A lot of the families of the inmates live near the prison," said upstate Senator Dale Volker. "It really doesn't make a lot of sense to take the prison people and say well, they came from Manhattan and therefore they should be counted in Manhattan."

According to nonprofit Prison Policy initiative, the 43,740 prisoners are the only reason seven upstate districts met the minimum population requirements for a Senate seat. The U.S. Court of Appeals for the Second Circuit also suggested that counting inmates, who can't vote, could be in violation of the Voting Rights Act.

    DID YOU KNOW that Rikers is the most expensive and failed "Correctional facility" in human history?

    You couldn't design a greater money-toilet if you tried.

    EX: every single day hundreds of buses must move inmates from Rikers and back to FIVE SEPARATE COURTHOUSES ON FIVE ISLANDS!!!!

    (Most jails are adjacent to the courthouse, so you just march the inmates down a few halls, saving taxpayers BILLION$$$$$.)

    It's just another reason you SUCKERS are the highest taxed humans in history. (Again, Scandinavians actually get stuff in RETURn for their taxes. YOU DON'T.)

    Even Team Bloombag has finally admitted Rikers wastes your money like nothing ever seen before, and have talked of closing it. But like most of Bloombag's rhetoric, it's ALL LIES ALL THE TIME.

    Bloombag himself says Rikers is a 100% FAILURE, as does the dishonest media who change their stories based on convenience.

    EX: The "official" claim is that 75% of people they "Correct" in the Dept of "Corrections" are not only not corrected at all but return to crime within one year.

    Nope. It's about 90% and many return to jail within DAYS of getting out, b/c 90% return to crime the second they're released, duh!

    I could tell you many more shocking facts but Gothamist is upset that I'm telling you things that may turn you against the Naked Emperor.

    FUN FACT:

    1. NY STATE has over 70 PRISONS(!!!) and most of those inmates are from... (can you guess?)... the "safest large city in America": NYC!

    2. These prisons just happen to be SLAVE LABOR CAMPS --- the largest concentration since... Nazi Germany (who also locked up lots of "criminals" and put them to work for little in return)

    These factory-prisons produce enormous amounts of goods from clothing to soap to furniture used in hospitals etc. (It's called "Core-Craft".)

    I could give you lots more interesting facts but the media would rather you know where Sarah Jessica Parker walked her dog today, or how much money ______ made at the box office this week.

    Why no complaints about Rikers Island? East Elmhurst gets an extra 14,000 transients added to its population.

  • If Rikers was located off of Oswego County in Lake Ontario, while containing 14,000 NYC inmates and counting them as Oswego County residents, then your question about complaints would compute.

    Urban, minority-majority areas are in some ways over-counted already because those districts are much more likely to count illegal immigrants in their population count, even though illegal immigrants cannot vote. The people counted in prisons upstate do really live there, so why shouldn't they be counted in the census as living there? Are we suggesting they commute to prison? This whole argument is ridiculous and I expected better from Eric Schneiderman.

    ok, youre saying urban distraicts are more represented because of illegal immigrants, and rural districts are ok with the education system benefits of warehousing urban balck males. so using that logic, the only honestly represented district is a suburban non prison county with an all white honest to god population??

    the problem is not who lives there, its that prisoners go back to urban hoods f'ed up by the war on crime created by the suburban lawmakers who get nice schools and facilities at the expense of urban black males.

    again, minorities dont trust the system, after all this is the system that created the same represenation formulas used by SLAVE states.

    if you really want to game the system, all released prisoners should move to their "home" county upste and take advantgae of the better schools and services, but guess what, they will just figure out another way to make being black a crime in that county until they go back to the hood they came from...

    i hate to say this, but are you white, i cant fathom a minority even being ok with facts as peresented.

  • Inmates do not "live" there. They are compelled to be there due to their judicial sentence.

    The only reason these individuals are counted as residing in these Upstate districts is so that Upstate politicians can represent their constituencies as being larger than they actually are--thus helping themselves to additional money and resources at NYC's expense.

    Schneiderman is correct that this situation needs to come to an end.

    The whole point is to count people where they receive services. Prisoners receive very limited services from the local community (slightly increased traffic for visitors). The vast majority of prison costs are paid for by the state (indeed, upstate communities lobby for prisons because they are an excellent source of jobs in upstate areas). If you want to say that prisoners aren't getting services in their communities due to their incarceration, fine, then don't count them for apportionment reasons in either region, but certainly it makes no sense to count them upstate.

    the same volker who stated that he pays more attention to cows in his 'district' than human beings. this is the reason for low turnout in minority neighborhoods, they already know that the wholesale warehousing of minorities helps upstate counties rather than their own neighborhoods, laws will always be passed by upstate lawmakers who benefit from destroying urban neighborhoods.

    Volker's district extending 75 miles from the Finger Lakes to Lake Erie is 95 percent white. More than half the prison population is black and nearly 80 percent of the district's black population is inmates.

    Volker believes it is fair to count the inmates as population because the prisons are where they are, and because, he believes, the 2000 census so terribly undercounted the population upstate. He is sure that his home county, Wyoming, gained more than 917 people in the 1990s, though he acknowledges it remains a part of New York with "more cows than people" and that between the cows and the inmates, he would sooner trust his electoral fate to the cows.
