Lowery's Stepdad's Outburst May Land Him Jail Time

Convicted killer Natavia Lowery's stepdad left a Manhattan courtroom in handcuffs yesterday after disrupting her sentencing, which has now been delayed to April 26th. Earlier this year Lowery was found guilty of killing her former boss Linda Stein. According to the Daily News, yesterday her stepfather screamed in court, "She has the right to change counsel under the sixth amendment." The outburst was brought on after the judge insulted the lawyer the Lowery's hoped to bring on board for the sentencing, noting he hadn't even read the case file. Due to other complications, however, Lowery's sentencing would have been delayed anyway. And now her stepdad faces up to a year in jail after being charged with contempt.

    If the consel was so bright how come they need did DNA to see who's blood was splattered all over the apt? Why her hands didn't show any signs of bruises or cuts?

    Arresting everyone but steins daughter.

    But be careful because she might throw her urine at you from her jail cell.

    The DNA is used to establish facts (that Ms. Stein's blood is the blood on the wall, not blood from another person); just basic stuff.

    Why would the murderer have cuts or bruises on their hands after beating to death an elderly woman with a stick (after initially striking her from behind so that there was no chance of her fighting back)?

    Why would Ms. Stein's daughter be arrested when she wasn't even there when Natavia Lowery murdered her mother?

    Presumably so, I recall she made some kind of motion about that before and the judge directed her to keep her counsel. As I recall she wanted to present some sort of alternate case theory and her counsel wouldn't do it. Sometimes what the client wants is not what's in the client's best interest. I'm sure her counsel had a very good reason for not presenting whatever she wanted to present but my memory is hazy on the specifics of it.

    The 6th amendment gives you the right to competent counsel after you have been charged with a crime. It does not give you the right to counsel you personally get along with and want to hug or provide any explicit right to change counsel whenever you feel like it.

    "In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district where in the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence."
