Woman Calls 911 to Remove Man in FDNY Uniform from Stoop

031910fdny.jpg A Windsor Terrace resident had a little trouble getting to her front door around 3 a.m. Thursday because a man in an FDNY uniform was passed out on her stoop. Naturally, Lauren Hill videotaped the scene with her Blackberry, narrating it with the annoyed commentary: "I can't get into my house because the FDNY, I don't know what he did, is sleeping in front of my door." This brave hero was probably up all night on St. Patrick's Day rescuing babies from burning buildings, and when he finally collapses from exhaustion, all this woman cares about is getting into her house! So she calls the cops on him. Hill tells NY1:

His head was leaning towards the door so the key was right above him so I did attempt to open the door and see if I can get in but that was to no avail. I was really having difficulty opening the door. He really needed to be out of the way I called 911 and I was like "I have to go to the bathroom and someone is blocking my door I can't get in."

Lucky for him she didn't have a Sharpie to draw penises all over his face. NYPD officers were dispatched to the scene of the sleep and roused the man, whose shoes were nowhere to be found. Hill says he eventually got up, but was incoherent, despite his declaration, "I'm good! I'm good." Her neighbors slept through all of this, but after watching the video, building tenant Lawrence Hill remarked, "I guess he thought he was home."

The NYPD won't confirm the incident, and the FDNY points out that the man might not be an active member, because the uniform is worn by retired firefighters and EMS. "I haven't seen the video but it's something I would look at," FDNY Commissioner Sal Cassano tells NY1. "It's not something I would expect of a firefighter in uniform. It's not something we stand for. But I haven't seen it yet."

    okay,the woman who called the cops works for the city,pd perhaps?she did the right thing.the fireman shouldn't have been drinking to the point of inebreation.but this is newsworthy?how about the court officer who was arrested that night for firing his weapon while intoxicated?ahh,didn't here about that one?that's because your police commissioner and your mayor tell the media what to report or publish.how about crime stat numbers being fudged?how about after that became news the precinct where the commander got caught messing with the stats had a fire in it's records room?all kept hush,hush by you know who.a drunk in uniform?get real will you.there are more important things to deal with in this city.pleeease.

    While I imagine some feminist is going to take issue with the "average sized woman," I see your point. I'm not disagreeing with what she did, she's definitely not in the wrong, I'm just presenting an alternate way it could have been handled, not a better way.

    She couldn't just roll him over and step on him on her way to the door? I mean, forget the uniform, its 3am on a holiday that, whether its supposed to or not, results in a huge amount of public intoxication.



    I love firefighters, but off duty, in uniform, shitfaced, they are just civilians, so she should have shoved him out of the way then called 911 from inside, just like you would do for anyone else.



    And calling 911 has less to do with getting the guy punished than making sure he doesn't choke on his own vomit. Everyone has a bit too much to drink every once and while, it would be nice if we tried to help them instead of trying to lock them up (of course, assuming they're passed out in public and not trying to fight a lamp post or a parked car)

    Look, she's an average sized woman who sees a big fat drunk man passed out on her stoop - a guy who could get belligerent if she wakes him from his stupor.



    So she does the only safe and reasonable thing she could - she called the cops to get him out from in front of his door.

    cops and firefighters are fame whores, they should be held to higher standards, drunk cop or fireman passed out on anybodys stoop in any uniform or civilian clothes should not be excused.



    what would have been the outcome if the guy wasnt a fireman retired or not, some black dude passed out on the stoop with missing shoes would have been arrested and charged with something as a freebie arrest.

  • Actually, the police department's job is to help you - unless you're a criminal, of course (in which case, calling the cops is, generally speaking, a really bad idea).

    I'm always shocked by the number of seemingly drunk firefighters -- in dress uniform -- on St. Patrick's Day. Why does the department allow them to go drinking in uniform???? Doesn't exactly instill confidence in NY's Bravest...

    A "normal" woman would not wake up a drunk stranger on a street past midnight even if is the front porch of her house, guess why?! Can you see any danger here?

    Uhm, maybe you heard of 9-11 where 343 of them sacrificed their lives trying to save other people? And the countless other times they selflessly died serving the public. That's a lot closer to sainthood than anything you've done I'm sure.

  • Wait, firefighters are human beings? I thought they were magical angels who never passed out from drinking? Listen; I've been there! He wasn't driving, or anything. Calling the NYPD is the right thing; then escorting the drunk guy home is the right thing. The end! Even if the guy is a firefighter right this instant, as long as he wasn't on the clock-- he's cool with me. I've been there, buddy, I feel yah.

    If he had been your average not too irish dude in plain clothes he would've been ticketed and/or arrested. Enough with the hero bullshit - these guys are very well paid to do their job.

    There is no public intoxication law in NY, nor is disturbing the peace. Disorderly Conduct would be a stretch, the DA's office would never prosecute it.

    fine and imprisonment."

    There is no article 114 of the NYS penal law. You can refer to 240.40, but that's for OTHER than alcohol. The law you're quoting is from 100 years ago. Its not in the current penal law, which can be viewed here:

    its common knowledge that you can be arrested / fined for disorderly, distrubing the peace and public intoxication.



    these laws are applied at the nypd's discretion and, for some reason, were not here.

    I'm pretty sure there's no charges for "disorderly" nor "disturbing the peace" and I thought that it had already been established that its only illegal to be intoxicated in public on OTHER than alcohol.



    So, in your infinite wisdom, what SHOULD he have been arrested for, since you're either a cop, a lawyer, a judge or a DA, with a full understanding of the law.

    Arrested? No. Summonsed? Yes. The proper PL code is 240.20 Subdivision 5, Disorderly Conduct: Obstruct Pedestrian Traffic. From what the article says he was clearly obstructing her from getting into her building.
