All Officers Acquitted in Subway Sodomy Trial

The three police officers accused of sodomizing a man inside a Brooklyn subway station were found not guilty this morning by a Brooklyn jury, the Post and City Room are reporting. Despite testimony from a transit cop who says he witnessed the assault, Officer Richard Kern has been acquitted on all counts of sexually assaulting Michael Mineo with his police baton during an arrest in a Brooklyn subway station in 2008. Two other officers, Andrew Morales, 27, and Alex Cruz, 28, were found not guilty of helping cover up the crime.

Those following the trial closely began to suspect last week that the jury might acquit after they asked the judge to define "reasonable doubt," and one juror was replaced after she told others (incorrectly) that Kern had prior convictions for police brutality. (The judge told jurors Kern had been "exonerated" of any previous brutality allegation.) Mineo was not in court as the verdict was read this morning; his civil lawsuit against the city is still pending.

    so after reading this thread i can only come to one conclusion:its totally absurd to think this cop didnt do this? even after a jury of his peers (um in BK also) acquitted him. the shame is when certain people only see the "disgraces" the NYPD commits and cant possibly fathom someone wrongly acusing a police officer of something wrong. Work one day as a memeber of the NYPD. before certain members of this ramshackle interney community countine to paint all members of the NYPD with the same broad brush at leat attempt to empathize with the job they do. and get the damn chip off your shoulder.

    on a side note. Mineo might look like a perp. But Kern deffinitly looks like a rapist

    Mr. Miller, the juror, said prosecutors never answered critical questions, like why there was no blood on the jeans Mr. Mineo was wearing during the confrontation. The jury asked the judge to play surveillance video from the day of the arrest in court. Though Mr. Mineo and another witness had testified that he had blood on his hand, jurors saw him place his hands in his pockets in the video and they asked to examine the jeans on their own. They found no blood in the pockets or the seat, Mr. Miller said. The jurors, Mr. Miller said, were also troubled by a hole in Mr. Mineo’s boxers: He said it was caused by the baton, but expert witnesses presented by the defense said that was impossible.
