Manhattanite Sues Nasal Spray Company For $75MM

nasalspray.jpg A Manhattan man is suing the makers of Zicam for $75 million after their Cold Remedy Nasal Spray stole his sense of smell and taste. Or so he claims. The lawsuit comes from Paul Buck Jr., who was the director of operations for an organization called Art Food LLC at the Metropolitan Museum of Art—a job that required impeccable senses! In the lawsuit he says he used the over-the-counter spray from 2006 to 2009, and now suffers anosmia as a result; he claims the company should have known that there were studies dating back to 1937 that show a topical application containing zinc ions (like Zicam) could "produce permanent anosmia." But how much spray was this guy using?!

    What the hell is he complaining about? NYC has so many stinky fumes why is he mad he will now miss them? Guess he never took the subway.

    I wonder if anyone reads the caveats on the medicine packages or advertisements or listens to them on broadcast commercials? The manufacturers know there are going to be problems and they hedge their bets with the disclaimers. However this doesn't stop the litigious.

    Got that one right. How many times do you see an individual or a couple smiling and lovey dovey as if it's the first time they discovered sex thanks to the newest miracle drug that cures whatever ails you only to turn the page and there is a two page spread done in 9 point type disclaiming everything thing from not using it with aspirin to staring at groundhogs in the moonlight.

    But as I read the comments above, the product should be looked at more carefully.

    Nasal srays are addictive and quicy lose their effect after much use, they should be pulled from the market. I use only saline sray.

    Don't assume that he was overdosing. I, too, lost my sense of taste temporarily after using their throat spray. I only used it once and followed recommended dosages.

    (I ranted about this before too.)

    In 2006 Zicam paid $12 million in a lawsuit connected to over 300 people who lost their sense of smell, many of whom only used the product only once. This stuff is dangerous. Hope this guy wins...this product needs to be pulled from all shelves if it hasn't already.
