Doctor Supports Alleged Victim's Subway Sodomy Story

This morning a doctor from the hospital visited by alleged victim of NYPD sodomy-by-police baton testified for the prosecution. Dr. Syed Ahmed said that contrary to the officers' testimony, it was "highly unlikely" that Michael Mineo's injuries were self-afflicted. Mineo went to Brookdale University Hospital on Oct. 15, 2008, immediately after the alleged attack inside the Prospect Park subway station. According to Dr. Ahmed, Mineo had elevated pulse and white blood cell count, which he said are "sure signs of a serious inflammatory response."

Although Ahmed conceded that the tear was "superficial," he testified that doctors saw bleeding and "a CT scan showed that one of Mineo's pelvic muscles was inflamed and swollen," the Post reports. John Patten, the lawyer for Officer Richard Kern, who is accused of sodomizing Mineo with the baton, has argued that Mineo caused the "superficial laceration to his rear end" by "digging, digging into his backside." But today, Dr. Ahmed said that was highly unlikely, because it would "cause intense pain, and you could not proceed."

Ahmed said he never examined Mineo but read from his medical records, which said, according to the Daily News, "The patient appeared to have sustained blunt trauma to the face and head and a superficial, non-penetrating anal-rectal injury requiring no surgery." Mineo checked himself out of Brookdale on October 19th, against medical advice, but returned four days later after symptoms worsened.

On his return visit, doctors "drained six ounces of pus from an abcess that had formed in the inflamed muscle after it became infected," Ahmed said. When one of the cops' lawyers suggested that the inflamed muscle was too far from the anus to be related to the tear, Dr. Ahmed reportedly laughed and said, "You don't have any idea about the human anatomy."

    Am only relying on the news reports cited above which states that The testifying Doc never examined the patient, and that Mineo went to the hosp right after the incident. So, without taking sides:

    1. Doc only examined records, and is being paid by Mineo's lawyers in a contingency multimillion lawsuit.

    Bias is possible, no?

    2. Elevated pulse is non-specific. Elevated WBC is non-specific, but if it is related to the rectal injury, it would imply that the injury occured quite some time before the sample was taken. Same with the CT scan. "Inflamed and swollen" actually does take some time, and would not be severe in an acute injury.

    3. Of course Mineo's DNA would be on the baton, there was contact.

    4. Just as likely is that Mineo had a pre-existing condition, such as a perianal or perirectal abscess, no need to imply infliction, may have just occured spontaneously before the incident. And those suckers do ooze blood & pus. Hence, DNA. if I were Kern's lawyers, I would drag up some experts to add on the pre-existing to the self inflicted possibilities.

    Aside from the testimony of some scared probie cop, IMHO the course fails the "resonable degree of medical certainty" as to the testimony and the "preponderance of the evidence" in the overall trial.

    But trials are performance art and innuendo, this one just has lots of racy aspects & stuff.

    Should be interesting.

    damm...so a cops testimony is questionable, then why do cops testify at criminal trials against criminals.

    of course mineos dna was on the baton? blood and feces on a baton is not standard police policy, thats an abberation of the most outrageous kind.

    cop lovers are running out of an audience for this kind of cop loving.

    No, just my read on what I have read. Wasn't there, and can only reply on what I (from the media, and you know what that's like) have been offered. Thus the disclaimer. When you have had experience with the surgical diagnosis and treatment of pelvic sepsis, expert witness testimony, CT scans, the trial process and such, please feel free to report back.

    this is case is great example of how people buy whatever the system shovels their way.

    look at the stories about the victim that first came out. they tried to kill his credibility. 'he's a criminal!' and many, many of the commenter's on this site defended the cops to the hilt, called for all sorts of violence against him...now it comes out

    the cop had priors!

    theres a witness who's a cope!

    the medical records back up what the guy said!

    nevermind the crazy notion that the cops would let someone off with a summons who ran from them!

    Obviously Dr. Ahmed has never needed the services of a lawyer. They certainly know where to find that part of the anatomy when they need to fuck their client!
