For the second time this month, video has surfaced showing NYPD officers beating men who appear to be prone and defenseless. Last week two officers were suspended after a witness came forward with video showing them beating a handcuffed man, and now a surveillance video shows three cops punching and kicking a man during an arrest in Bed-Stuy on New Year's Day. The most violent part is probably seen at the 44 second mark:
The assault occurred during the NYPD's attempt to disperse a large crowd that had gathered around a fight in Bedford-Stuyvesant around 5 a.m. on Jan. 1st. During the pandemonium, police say Nagi Benson and Davial Rowe, 23, punched 79th Precinct Officers John Balestriere and Gregory Clark. Neither men are seen throwing any punches on camera, but this video doesn't show what happened out on the street before the arrest, only the aftermath in the alley.
The police report says Benson was "flailing" while cops tried to cuff him, but the video seems to contradict that, showing him prone on the ground as three cops hit and kick him. "These cops seem to act like a criminal organization rather than a municipal police force," Benson's lawyer, Fred Lichtmacher, tells the Daily News. The Brooklyn DA says NYPD Internal Affairs is reviewing the tape, and Benson, who has a rap sheet that includes arrests for marijuana possession, reckless driving and gun possession, is preparing to sue the city for $5 million. Rowe, his friend, plans to sue for $1 million, but the nature of his complaint is left unclear in this morning's Daily News exclusive.
