Video Shows NYPD Beating Perp During Arrest in Alley

For the second time this month, video has surfaced showing NYPD officers beating men who appear to be prone and defenseless. Last week two officers were suspended after a witness came forward with video showing them beating a handcuffed man, and now a surveillance video shows three cops punching and kicking a man during an arrest in Bed-Stuy on New Year's Day. The most violent part is probably seen at the 44 second mark:

The assault occurred during the NYPD's attempt to disperse a large crowd that had gathered around a fight in Bedford-Stuyvesant around 5 a.m. on Jan. 1st. During the pandemonium, police say Nagi Benson and Davial Rowe, 23, punched 79th Precinct Officers John Balestriere and Gregory Clark. Neither men are seen throwing any punches on camera, but this video doesn't show what happened out on the street before the arrest, only the aftermath in the alley.

The police report says Benson was "flailing" while cops tried to cuff him, but the video seems to contradict that, showing him prone on the ground as three cops hit and kick him. "These cops seem to act like a criminal organization rather than a municipal police force," Benson's lawyer, Fred Lichtmacher, tells the Daily News. The Brooklyn DA says NYPD Internal Affairs is reviewing the tape, and Benson, who has a rap sheet that includes arrests for marijuana possession, reckless driving and gun possession, is preparing to sue the city for $5 million. Rowe, his friend, plans to sue for $1 million, but the nature of his complaint is left unclear in this morning's Daily News exclusive.

    The amusing thing about the police is, when they're out of uniform, they look just like the criminals.

    Are you guys watching the same video as me? The "victim" in this video is clearly resisting arrest: he refused to get on the ground and later when he finally was knocked off his feet he continued to flail his body. In other jurisdictions this guy would simply have been tasered and that would have been the end of it. Also, the officers restrained from using their nightstick or baton despite the resistance they faced.

    who released the surveillance video? since it's the cops who try to obtain any and all video tapes in a crime scene.

    that's why people should always make a copy, don't hand over anything to the cops.

    you should change the headline from 'Perp' to PERSON.

    Its shameful that when somebody alleges police brutality everyone is quick to defend the cops and condem the victim. Long ago cops beat my father up when they arrested him. They hit me when I had a run in with them as a kid. Police brutality isnt some myth minorties made up, its real. A lot of you are just in denial.

    conversely, it may be good to bear in mind that cops were responding to a brawl. it is entirely possible that the men in the video were directly involved and so "perp" could be exactly what they are and obviously what police call arrestees.

    since both the cops and the "victims" in the video are being accused of wrongdoing, suspending judgment is probably the best way to go.

    i was actually coming back here to say just that.

    theres no evidence from the video or the article that hes a PERP or was involved in a streetfight or had an altercation with an officer before the alley.

    either way, nobody deserves a beating when they are on the ground facedown. theres not alot of resisting that a person can do facedown that constitutes force or physical harm to the arresting officer, especially the three on one scenario on the left side. his previous arrest background is irrelevant since he wasnt identified before he was arrested.

    as a white looking guy i just tell officers look it up, what does that matter, check your records you know better than me. its a brainwash mindgame that the cops play when trying to arrest someone to make them think they deserve rough treatment.

    remember when ghouliani claimed the dead guy was not achoirboy, turns out he was....and he revealed sealed juvenile records illegally.

    Yeah I remember that case. The loyalty is to the cops, it doesnt matter what the cops do. The system protects itself. In every incident where police are accused of something, somehow the persons full criminal record is released with the story.

    it done as if to say 'Dont waste your sympathy on this victim, don't be outraged, they were bad people, they deserved whatever happened to em.'

    thats how they talk about sean bell. plain clothes police shoot an unarmed man, but we're supposed to overlook that cause he had a record.

    I was surprised caus this was posted by John who usually seems more perceptive, but oh well.

    A large crowd gathered around a fight in Bed Stuy @ 5am on New Year's Day. I can only imagine what a scene that must have been. It's a shame the cops responded to this call-maybe some of these revelers could have killed each other

    Yea seriously they had to wrestle those perps down to the floor and you see them kicking and struggling. Bunch of whiney pussies in this city these days, back in the bad days when a perp fought a cop and got a crack in the head it was expected.

    This is how exactly Bloomberg/Kelly feel and why they don't condone it. however the taxpayers pay for it. NYPD gets away with shooting civilians because their defense is fear of their life even if the civilian was just holding an ipad. However the beatings and sodomy cases isn't so easy to escape from since they (NYPD) obviously weren't in "imminent danger". NYPD can't beat or sodomy someone for resisting assist.

    To say that he was just lying there prone is total bs. Watch the video and notice where they first go tumbling to the ground. The guy lays still for like a second and then starts trying to get to his feet. He then starts moving forward and you can see that on the tape they end up in a different spot from where they started. At that most violent point, the 44 second mark, you can see he's moving the pile quite a bit which is why they are punching and kicking him. The police are allowed to punch and kick you if you resist arrest.

    These cops aren't keeping us safe - now these preps will walk free with a FAT check, courtesy of NYC taxpayers. The issue is with Bloomberg/Kelly who treat the NYPD as their personal ARMY. The blame Bloomberg/Kelly who permit this behavior by not condoning it. Bloomberg is tight with the police union which is why they endorsed him unlike FDNY. Shame.
