L.I. Town Makes It Illegal To "Wave While Latino"

In an attempt to punish day laborers and those who employ them, the town of Oyster Bay had implemented a controversial law that immigrant rights activists say makes it illegal to "Wave While Latino." The new legislation imposes fines of $250 on people who solicit employment, which "includes, but is not limited to, shouting at cars, waving arms or signs, making hand signals, approaching motor vehicles or standing in public roads facing in the direction of oncoming traffic," according to the Times.

The ordinance passed the Town Board unanimously in September after outcry over a group of many as 80 laborers who gathered at the intersection of Forest Avenue and 12th Street and purportedly caused problems including public urination on private lawns. "I'm not anti-immigrant, but their need to be employed doesn’t mean they can cause chaos on our streets," said town supervisor John Venditto, who is the son of an immigrant. "I'm not looking to put anybody in jail … Maybe I’m living in a fool’s paradise, but I believe the day will come when people say, 'Son of a gun, he was right about this.'"

Despite protests and threats of legal action from the New York Civil Liberties Union, the town has stood by the new rule. But Latino residents of Oyster Bay — who constitute just 6 percent of the town's population — say it makes life more difficult. “Everybody wants to be a U.S. citizen,” said illegal immigrant Abel Villalobos, 48, who came to the United States after fleeing from political turmoil in El Salvadore. “But now we are afraid to go to the corner to find work.”

    What is the argument here? every single alien "BROKE THE LAW!" Our Government, past & present, Republican & Democrat, have allowed the invasion of 20 to 30 million criminals and uneducated peons which is the largest invasion of any Nation, at any time, by any means & in direct violation of Article IV, Section IV of our Constitution.

    This refusal to abide by our Constitution or enforce our Immigration Laws should be classified as Treason of the most foul kind, & as grounds for impeachment & trials for Treason!

    Not only have they allowed the invasion, they force American tax payers to pay Billions on Billions of dollars to provide Welfare, Prison cells, Educate the invaders numerous children, and free medical care, at the same time the invading horde break numerous laws and massive document fraud, & are destroying our schools, hospitals, communities, culture and standard of living while Robbing, Raping, Killing & Assaulting American Citizens WAKE UP PEOPLE!

    Well, my Latino *&^ is going to wave to cars every single time I come around one of these areas, just for the fun of it...and to prove how silly this is.

    The easiest solution is for these people not to be out on the streets looking for work.

    I've seen some of these pick-up places. Pretty nasty and some spots they have completely taken over business parking lots and bathrooms.

    Get rid of'em.

    The real joke of the story is immigrant rights activists..Do any of these "illegals" who are looking for work do anything legal??? If this legislation that indeed punishes illegals in this town then good for them..Local economies suffer enough without having hordes of illegals live and work free of the tax burden system that we citizens have to endure..The law is designed hopefully to move these illegals to another town..Of course there is no guarantee that individuals will infact still continue to hire them but what law can be enforced for that?

    Apparently no one got the memo that people are not illegal. They are undocumented. It is not illegal to exist.

    Regardless, what this law does is essentially allow for greater racial profiling of Latino immigrants in Long Island, who according to studies have contributed millions to the Long Island economy. Laws like this allow for more Marcelo Luceros.

    of course it has. the rich are getting richer b/c they're spending less money on the workers.

    as a matter of fact, i hate laws like this where it tends to blame the undocumented workers.

    if you're going to hire anybody, please hire them at the minimum wage. i don't care if they're documented or not.

    the real problem--which so many people seem to miss, is that no one's blaming the employers for spending little money so they can help themselves.

    amazes me.

    easy cash, easy lines of credit, quick homebuilding and lots of remodeling, non union labor, cheap labor, etc etc.

    take all that away and now these guys are loitering criminals. right on.

    They should confine themselves to Home Depot parking lots where contractors easily find them and the store seems to welcome them. If there were a group of men loitering on my corner and pissing on my lawn, I'd be pretty annoyed.

    Yes, punishing the immigrants is clearly the way to go. The scumbags who hire them definitely won't just find some other illegals to fill their places. Not...at...all.

    Yeah, I'm waiting for the other half of the article where it describes how the town will levy heavy fines against those who hire illegal workers and reports any infringing businesses to the IRS for evading payroll taxes.

    I'm sure they'll get around to that.

    i don't even like the title of the article. it's really scummy to hire people less than the minimum wage in the first place.

    if these employers hired the illegals at the minimum wage *or* matching the legal workers' salary (like that'll ever happen), my case is entirely closed.

    i hate greed.

    people hire illegals b/c they're cheaper. i'd say, make the employers pay hefty penalties for hiring illegals when they're caught, so that they won't do it again.

    i don't think it's entirely the illegals' fault. the people who hire them should know better too.

    makes my fists clench.

    The Oyster Bay law is obviously unconstitutional. Everyone has a right to be on the streets, talk, wave, look for work, and so on. If you don't understand this you don't understand the most basic things about the Constitution.

    If the government of Oyster Bay wants day labor to be better organized, I'd suggest they organize it: designate a vacant lot, parking lot or storefront, and provide some services to those hanging around and those looking to hire them. They might even be able to make some money by renting out a concession for a cofee-and-danish truck.

    the constitution is the law. illegals aren't under the protection of the constitution, by definition. there should be different measures since there is no precedent. y'see, i'm not advocating that they be thrown out.

    if we toughen the law so that it's impossible to hire people with less than minimum wage, then we may be going the right direction.
