Kite Fight Leads To Lawsuit Against City

One 12-year-old was recently the victim of some kite fighting leftovers. The "sport," made famous in The Kite Runner, is popular in Flushing Meadows Corona Park — and now the city is on the receiving end of a lawsuit over it.

The Queens boy was skateboarding outside of his apartment last month when he was clotheslined by a razor-sharp wire that had allegedly fallen from a kite fight. The NY Post reports that "the glass-encrusted wire ripped into the then-12-year-old's throat and left him scarred from ear to ear from a wound his lawyer said took 400 to 500 stitches to close. The boy also lost two lymph nodes in the accident." The boy says he "heard a noise like bees... I thought I went into a beehive."

The lawsuit against the city states that they shouldn't allow the kite fights to take place in the park, and also notes that they "failed to remove the wire that was left hanging between two buildings after getting severed in a duel and drifting over to the complex." The family's lawyer declares, "The city should have known these kite festivals are happening in Queens parks — and should have known the danger that the glass-encrusted string poses."

You have got to be kidding me.

In other news, everyone who has ever been the victim of a crime has sued the city, county, and state in which the crime occurred. They claim that the government has a responsibility to protect its citizens from anything bad happening to them at any time, and that if the government should fail for any reason, it is society's responsibility to pay the victim a massive amount of money.

True. I never heard of this strange thing you call a "kite" until I read that book.

usually i'm against suing the city for every little thing, but this doesn't fall into that category.

kite fighting, even before that movie, has been shown to be dangerous to non-participants, so if someone knew that this stupidity was taking place in a public park, then yes, the people responsible for the public park (in this case, the nyc gov) should have prevented it. morons who kite-fight should be arrested.

The lawsuits don't sound completely unreasonable, depending on the facts.

The co-op could have the duty to remove any hazardous thing on their property.

As for the kites in the park, if the types of kites being used and the way they're being flown really are as dangerous as the article suggests ("Using power drills to reel in the ultra-sharp wire..."), the city might have a duty to either ban this activity, designate areas for this activity, or at least put up signs warning others of the potential danger.

I think I've read reports of people in Afghanistan being decapitated from these kite wires. This kid almost got decapitated, I don't think his complaint is entirely unreasonable.

I believe they were decapitated for committing adultery or drawing pictures of Mohammed.
