9/11 Suspects To Be Moved From Gitmo To NYC For Trial

2009_11_ksm.jpg The United States will try September 11 attacks mastermind Khalid Sheikh Mohammed, as well as four other 9/11 terror plotters, in New York City. Federal sources say that U.S. Attorney General Eric Holder will make the announcement today; President Obama didn't confirm the details, but did say from Japan, "I am absolutely convinced that Khalid Sheikh Mohammed will be subjected to the most exacting demands of justice."

Mohammed was captured in 2002, after being in various prisons (the NY Times reminds, "Documents have shown that the CIA used waterboarding — a controlled drowning technique — against Mr. Mohammed 183 times in March 2003"), and moved to Guantanamo Bay in 2006. In February 2008, the Pentagon finally charged Mohammed and other suspects and he pleaded guilty to the charges in December, but these were military commissions from the Bush era "before the Obama administration froze those proceedings." The Times adds, "It was not clear what charges they would now face in civilian court."

ABC News reported yesterday, "Officials in New York say they have not been informed of any decisions, but Manhattan's federal courthouse has often been cited as a "sentimental favorite" for the 9/11 trials. Like the now-destroyed World Trade Center, it is in lower Manhattan. The Southern District is also one of the jurisdictions in the United States with the most experience trying terrorism cases."

very strange story, a true patriotic constitution loving democratic civilian court would not accecpt that any defendant is tortured & waterboarded 183 times in a one month period.

it will be a show trial kangaroo court with alot of national security secret evidence claims.

Dumb, dumb idea. If convicted, even a first year law student could argue successfully that KSM couldn't receive "fair" trial in NYC. Secondly, if he's to be tried by his peers, does it mean, at least some Muslims must sit on a jury? That won't end well.

Is this not America? Do we not have due process? You may hate this guy, but as an American, give him the same justice as anyone else, regardless of the gravity of the charge. He deserves a fair trial by jury nevertheless.

This specimen is not an american citizen, nor is he a member of a recognized foreign fighting force - therefore he is entitled to neither due process in a civilian court, or the rights afforded a POW in a military court. There is a reason these creatures were designated enemy combatants.

He will now have rights that he has no right to, and he play this as the circus it will become.

This is a shameful day for our country, and President Obama has made a grave mistake.

maybe those dicks shouldn't have pulled "enemy combatant" from their asses and rather stuck with the original legal def and rights afforded with "unlawful combatant" perhaps we wouldn't be here in legal limbo right now. and i agree, executions are warranted if the prisoners are actually guilty of anything. but given the muddled fuck up that guantanamo is, the truth is far from clear.

The only reason they were designated enemy combatants was the Bush administration decided it. Skyjackers from the 1970's, Cuban terrorists and captured PLO terrorists were not. Even some former Bush people believe it wasn't a smart, thoughtful long-term decision.

do yourself a favor and re-read the Constitution. Regardless if isn;t American, the crime was committed HERE ON AMERICAN SOIL and sahll be tried in such location, PERIOD. Hey Bostonian, got a ticket in Jersey? Guess where you're going to go to court.

this trial wil be a hot potato for any lawyer willing to take the case, remember what happened to Lynn Stewart in the Abdel-Rahman case.

Lynn Stewart plead guilty and apologized for passing information she clearly knew was illegal. She never had any legal protection to do what she did. Mob lawyers go to prison for the same nonsense every now and then.
