Reports: Taconic Crash Driver Was Regular Drinker, Pot Smoker

2009_11_schul2.jpg The woman who killed eight people, including herself, when she drove her minivan the wrong way on the Taconic Parkway was a heavy drinker and frequent marijuana smoker, the woman's sister-in-law told investigators. Despite her husband's repeated claims that his wife wasn't an alcoholic or regular drug user, Diane Schuler's in-law revealed to police that the 36-year-old "was a hard drinker" who "used marijuana daily because of the fact that she didn't believe in doctors," according to an attorney representing the families of two men killed in the July accident.

While a toxicology report that indicated Schuler consumed a significant amount of marijuana and more than twice the legal limit of alcohol in the hours before the crash, her husband, Danny Schuler, has publicly denied that his wife suffered from drinking or drug problems and blamed the accident and on other medical issues.

However, reports today indicate that just two days before the crash, he had a few beers and his wife had a few daiquiris at their upstate campsite — a revelation that infuriated relatives of the victims. "It's totally the opposite of what [Danny] Schuler said at a press conference in August," said Micheal Bastardi Jr., whose dad Michael Sr., and brother Guy died in the crash. "It's disgusting. It was all lies."

You have to hand it to Dan Schuler, he held out this long. Did he really believe it wouldn't be discovered? His wife caused enough grief, you just added to those of the Bastardis as well your own family. Someone was giving you bad advice. Also the Police involved should have been able to find this out within a couple of days after the tragedy. I hope we're not looking at a cover up here.

The police were investigating a car accident. Whether she drank or smoked regularly was irrelevant, what mattered was what was in her system at the time of the crash. There'd be no reason for them to report anything beyond that even if they did happen to find out during the course of the investigation.

Thank you! I am so tired of hearing about her habits. Who the fuck cares what she liked to do nightly? What does it have to do with anything? What matters is that she got shitfaced on a Sunday morning and took a bunch of kids for a drive!

You're wrong, the police are supposed to investigate. Do you think they should have accepted the husband's denial and let it go? What happened on the Taconic was manslaughter at best, murder at worst. This horrific crime deserved every effort possible. Two devastated families are involved, and answers are needed.

Sorry Mr. Mell, the Police had an open and shut case when they got the toxicology report.

True enough and the perpetrator was Diane Schuler.
Sadly, she's hardly a flight risk. While deplorable, Danny Schuler's actions before the tragedy is likely not criminal. His civil liability is something else and for a judge to determine.

Her history, while tragic, is out of scope for the investigation of the Crash. The scope of their investigation was to determine the cause of the crash only. They found that out pretty quick.

Anything after that is for the victims lawyers.

Of course not, and they didn't. The toxicology report proved that she was intoxicated at the time of the accident. That's all that matters. If she had lived, she would have been prosecuted. She died, so there was no criminal matter remaining -- so no reason for police to be further involved.

Now it's moved to a civil case, and it's up to the plaintiffs in the case to establish fault and background. The police don't and shouldn't help out either side in a civil lawsuit, beyond possibly being called to state what they learned in investigating the accident. But again, it doesn't matter whether she was drunk every day before this happened in terms of the accident investigation itself. Even if she'd lived and been prosecuted that wouldn't have been relevant except perhaps when it came to establishing a sentence.

I wish I had known her. Sounds like we could have partied.

You have to be out of your mind to be stoned and drunk and just drive with kids in heavy traffic. Both substances mixed make anybody disabled to drive...specially in highways.

You mean she wasn't a sales rep for a big pharmaceutical company and about to blow the whistle on one of its ineffective cancer treatment drugs, and wasn't slipped an alcohol-laced smoothie and propofol nasal spray in order for her credibility to be suspect and subsequently fired?

And knowing this, you would let your children go with her why?

Get out of here! You mean to say the lady that drove the wrong way down the parkway and whose blood contained massive amounts of alcohol and marijuana was actually impaired buy said alcohol and drugs and not "other medical issues"? You're pulling my leg.

they did. The police report was dated July 31. It was just released. The police have know this all along.

Which also goes to show Danny boy had already made the sworn statement to police that his wife smoked pot and drank two weeks before he went on nationaltv saying exactly the opposite.
