Former Commish Kerik Cries During Court Appearance

Former NYPD Commissioner and Giuliani crony Bernard Kerik could not hold back the tears during his court appearance yesterday to plead guilty to eight felonies. According to the Daily News, "As the judge spoke, Kerik seemed to take measure of the magnitude of his fall. He bowed his head and repeatedly wiped his eyes with his fingers... Kerik kept daubing his eyes, his face going red as if with the strain of all he was trying to hold in. He did not seem to be weeping so much as seeping." Wow, we felt zero sympathy for Kerik yesterday, and now we feel twice as much!

Yesterday Kerik confessed to lying on his application to be the director of Homeland Security, lying to the feds, tax fraud, and accepting $250,000 in renovations to his Bronx apartment, provided by a company accused of having mob ties. As part of the plea deal, he will most likely receive a far lesser sentence than the 60 years he faced if convicted on all charges, and federal prosecutors will drop the corruption charges against Kerik. Judge Robinson remarked, "I think this is a very sad day."

The Times also notes that he will not be prosecuted "by the United States" for certain unspecified "business activities abroad" between 2005 and 2007. It's unclear exactly what activities investigators were looking into. By 2005, Kerik had already left Giuliani Partners, and the Bronx DA had launched an investigation into the apartment renovations. But Kerik is still named as head of The Kerik Group, LLC, "an internationally respected global provider of Homeland Security and industrial security services." Probably time to update that website, Bernie.

In 2003, Kerik served as the interim minister of interior in Iraq, and was in charge of training Iraqi police for duty. Retired Lt. Gen. Ricardo Sanchez blasted Kerik's work in his memoir, writing that when Kerik left Iraq he was "shocked" to find that the only items Kerik purchased for Iraqi police were 50,000 Glock pistols: "When I was informed of the exorbitant prices that were being paid for these pistols, my first reaction was that there had to be some impropriety, but I had no evidence to substantiate it."

    I'm so glad that this self righteous sanctimonious hypocrite got his in the end. Now I get to see Bernie on the Gurnie Kerik, Deputy Dawg Droopalong to Giuliani, put in the slammer where he belongs. What I don't understand is why hasn't Giuliani followed him to jail?

    In the plea agreement, prosecutors suggested to Judge Stephen Robinson that the appropriate sentence would be between 27 and 33 months in prison. Robinson noted that he is not bound by that suggestion when he sentences Kerik on Feb. 18. The judge said the maximum sentence is 61 years.


    The key is that prosecutors "suggested" and the judge is "not bound" to that. A lot of periods in your comment doesn't make you more right.

Unless Bernie has any dirt on Rudy to sell, he deserves the maximum in jail. The Judge said he would consider Kerik's accomplishments when he sentences him. Kerick's accomplishments were based on Lies and fraud.

    For the rest of you ill driven animals that feel compelled to publicly comment on articles about people that dont have the means to defend themselves, you need to look deeply at your own unhappiness and miseries before casting stones. This man pleaded guilty to victimless crimes. He didn't hurt anyone the way people are deriving pleasure off of hurting someone of his caliber.

    He was facing 62 years and the Federal prosecution gave him a 33 month plea deal. It seems Kerik still get the special treatment.

    Not so special at all. I haven't seen the indictment, but my eductaed guess is that 60 years is what the maximum is under the statutes he pled to, and only if each sentence is run consecutively (do 10 years for one crime, then start serving 10 years for another, etc.).



    However, the 33 months is most likely what is called for under the United States Sentencing Guidelines, and also reflects that the sentences on each count will run concurrently (you are serving all the sentences at the same time so they don't stack up), which is the way sentences are imposed unless certain circumstances exist.



    The judge is still free to do whatever he wants though, up to and including the 60 years. The plea agreement really only sets out what both sides believe the Sentencing Guidelines calculation to be. If the judge disagrees with that calculation, he can make his own.

    With the high conviction rate and the evidence that they have, I don't understand why the feds agreed to a plea bargain for only 33 months when Kerik was facing 62 years maximum.

    Don't get hung up on the "60 years" figure. That is misleading. Even if he went to trial and was convicted, the Sentencing Guidelines range that applies (where the 33 mos. comes from) would be substantially below 60 years. It would be higher than 33 months, but not necessarily that much higher. Even if it were double, a trial involves a lot of cost to the government and the chance that they could lose (no matter how small a chance, just look at the OJ trial). The 60 years would be the same if he went to trial and lost, but he still would not get a sentence that long. The Guidelines are really what drives the length of the sentence. So, don't think of it as 33 months vs. 60 years. It is probably more like 33 mos. vs 57 mos., or something like that.



    In addition, the plea agreement (assuming this is the standard plea agreement used in the Southern District) contains a provision whereby Kerik waives his right to appeal any sentence of 33 months or less, and waives his right to withdraw the guilty plea even if a higher sentence is reversed on appeal. So, this also puts some finality on things as opposed to having it drag out for years with appeals.



    Finally, one thing we got out of this was Kerik actually admitting his guilt. If you go to trial and lose, you can still always say "I didn't do it, but the jury got it wrong." This guy had to stand up in open court and admit to multiple crimes.
