Alleged DWI Driver Arrested For Fatal Crash

2009_10_bkcrash.jpg Early yesterday morning, a 48-year-old man was killed when a suspected drunk driver T-boned his car in Bensonhurst, Brooklyn. Jorge Cortes, of Maryland, was charged with "manslaughter, vehicular manslaughter 2-degree, criminally negligent homicide and DWI," according to WABC 7.

Relatives say that Eugene Malinsky had left work to pick up his stepson. They were traveling east on 86th Street when Cortes' car, traveling south on 21st Avene, apparently went through a red light, according to witnesses. Cousin Eugenia Kaplan said that Malinsky, who was from Kiev, Ukraine, had been diagnosed with cancer after the Chernobyl incident in 1986 and immigrated to the U.S. 20 years ago. She added, "He was an extremely nice person. He was nice to people."

Malinsky's stepson was taken to the hospital in stable condition while Cortes was in critical condition. Kaplan said of Cortes, "I just want this guy to be punished."

How do you put a stop to this other than with education and stiff penalties? Unfortunately, punishment often comes too late for some people like Mr. Malinsky but can it be a real deterrent? If applied harshly and across the board it might make some people think twice.

Want to make a penalty for drunk driving with some real teeth? First offense: Loss of license for life. Penalty for driving without a license once you've lost it for DUI: One year prison. Second offense: Ten years prison.

Well, if you're going to take away the license immediately on conviction, the driver has no need for a car anymore, right? Concurrent vehicle forfeiture sounds good to me, and selling the seized cars at police auction would help the bottom line.

Spirit of 76, that's a little silly. Drunk driving fatalities happen EVERYWHERE; and if anything, people are less likely to die this way in New York, where relatively few people rely on cars to get around.

Relatively few people? Tell that to all the people stuck in traffic.
