Bronx Man Pleads Guilty To Daughter's Murder

2009_10_mat.jpg Miguel Matias pleaded guilty to strangling his 14-year-old daughter and throwing her body into a Bronx building's boiler in 2008. Earlier this year, rape and incest charges were added against him, because DNA evidence showed his daughter was 12 weeks pregnant with his child. With this plea, Matias faces up to 25 years to life in prison; his lawyer said he would have faced up to 50 years to life if the case went to trial, "We had to [plead]. It’s not a triable case."

Seems like there should be a charge for the mother- or any other adult in that home- what a horror

Geez, talk about a loser. If you really need to get some, there are hookers available all over the city.

"With this plea, Matias faces up to 25 years in prison"

According to the post article the plea is to second degree murder, which is an A-1 felony. That means a minimum of 15 to life and a maximum of 25 to life.

  • Thanks—I've revised that to reflect it's 25 years to life.

    He'll be tried in prison

  • angry_pickle

Yeah sure. Will he be raped in prison? Very unlikely. Will he be dumped into a boiler? No. So no, he will not be tried in prison.

What kind of totally lazy prosecutors do we have in this city?!

If the defense attorney knew he had a loser on his hands that's when the prosecutors should have tightened the noose (as it were) and said "No deal we are going for a life sentence; see you at trial." The trial would have been over in a week and justice would have been served.

Frankly, this one of those rare cases where the judge should not accept the plea and either sentence the fiend to 50 years or demand that the DA's Office get off their butts and go to trial.

There's always the chance that the person on trial could go free. Look at OJ.

  • Vertigone

It's unfathomable that someone who committed this crime could someday walk free.

I am against the death penalty, but for this one I'd make an exception.

" if the casewent to trial, "We had to [please]. It’s not a triable case.""

    Does anyone proofread these things?

  • Mr Mel

The answer is a definite no.
