Naked Neck-Licking Home Invasion Definitely Counts as Sex Abuse

100709necking.jpg When courting a young maiden, it is acceptable to formally introduce oneself through a mutual acquaintance in society, or by sending a virtual "wink" through the social networking website of your choice. Other methods, such as honking one's horn or pretending to be a Rockefeller, are generally considered unacceptable. But what about breaking into a woman's apartment, stripping naked, getting into bed with her and licking her neck?

Not only is that a no-no, but it counts as sexual abuse, too. Wahid Sene, 36, tried that approach back in 2006, when he made his way into an unidentified victim's Lower East Side home as she slept and went for her neck in the nude. He was convicted and served two years in prison for the assault, but his lawyer sought to overturn the conviction, arguing in state appeals court that "because the neck is not located in proximity to sexual organs, and is not generally covered with clothing, it cannot be considered an intimate part of the body."

The five-judge panel unanimously rejected that argument and upheld the conviction, ruling that the neck qualifies as an intimate body part because it wouldn't be touched "in the absence of a close relationship." But what do you think, ladies? Is your neck intimate? What about the earlobe? We just need to know what the rules are.

The least intimate body part is the hand. It's not usually uncovered and it's the most likely to be touched. If someone refuses to shake hands with you and you try to force it, then it's wrong.

ha, so if a naked stranger crawls into your bed and licks your hand it's kosher?

No, because there is an expectation of privacy when sleeping in your own bed. She doesn't have to say NO.

It's still assault and trespassing no matter if it's sexual or not.

you're kidding, right? someone breaks into my apartment, crawls into bed with me NAKED, and licks my neck?

i think the lawyer-ese necessary to make the charges stick to ol' freaky mccreepy was pretty deft footwork, but IMHO we absolutely cannot separate the neck-licking detail from the whole picture of this crime.

yes, a neck touch is intimate (just imagine your boss touching your neck...). but so is any other sort of premeditated touch from someone transgressing a social boundary. and in my world that means ANY touch. a handshake, too, is invited in our culture. we don't grab someone's hand. we hold ours out and offer.

if a stranger tried to hold my hand on the subway, i would consider that assault. it's the intention, not the body part, that makes the crime here. if he had accidentally tripped and his face, tongue out, somehow landed against her neck, in a public place where they just happened to be at the same place and time, i seriously doubt she would have pressed charges.

this man did not trip and fall into her apartment, naked, next to her in bed, with his tongue hanging out. dig? that poor woman must have had a hard time sleeping after that.

i kinda respect this guy for being a kinky pioneer. you gotta admit his fetish is a bit unusual, even in this town.

licking is a little odd, I much prefer kisses!

according to our natural rights, no one is allowed to enter into our domain without proper consent. Our domain meaning our bodies, our home, etc. Anything considered our property.
